Alright so me and a friend were driving down a street (2 separate cars) and we had no intention of street racing. We turned to a busy street and increased our speeds, we were going 5-10 max over the speed limit it was a 35 and we were going 40-45 mph on it. Everything was fine until we turned to the side street that leads us to our house, that is when we saw the lights and the cop pulls us over. He claims that he got complaints of 2 kids street racing on the intersection that we were on. So he takes our license and registration (for both cars) and tells us that he is "going to be nice" and instead of arresting and impounding our cars for street racing he is going to give us 2 tickets for speeding 50 on a 35 (radar) and illegal screeching of tires. I have a radar detector, I had no detection of a radar taking a reading at my car and he wasn't even behind us he got a call and started following us and pulls us over literally RIGHT by our house and gives us the ticket that we got pulled over on the intersection? I feel that I should plead not guilty because he was "being nice" and gave us 2 tickets that have no evidence, speeding I don't think he could have had a radar on us if he got a call and illegal screeching of tires? We didn't even burn out I have brand new tires and I don't want to burn them up.. HELP1!

-We were NOT side by side I was behind him.
-Radar/Lidar whatever how is he supposed to catch me when he got a call and pulled us over 2 feet away from my house and wrote on the ticket that he caught us at that intersection which is a mile away from my house.
-Radars are LEGAL here so that doesn't matter.
-The cop CAUGHT us by our house and accused us of speeding? He pulled out of nowhere by our area and he said this clearly to me "i'm cutting you a break and im gunna give you a speeding ticket 50 on a 35 but i'm PRETTY SURE that you were going faster" he is guessing by himself..
so i'm getting a basic answer of pleading GUILTY..

If you did not do the violation, do not plead guilty.
However, the ticket was for speeding, and you were going over the limit. Unless 5-10mph over is different from 15mph over in your state, you've still done it.
Some radars can go undetected, and officers don't even need radar to give a speeding ticket. They can use other methods such as LIDAR, pacing, or even estimation. All they have to do is prove beyond a reasonable doubt that you were going above the speed limit. |

Think about this first, you already got a brake so ask the judge if you can take defensive driving for the speeding ticket and the screeching of tires ticket wont be a big deal. |

Funny thing about radar detectors, they detect RADAR which isn't used as much as it used to be, they use a different form so that radar detectors don't catch it as easily. Another thing is that I'd suggest making sure they are LEGAL where you live before you try to use that as a defense. Now you may have been going 50, you admit to going at least 40-45. Next you admit you were driving side by side, so could very easily give the appearance of racing when you were going that speed. You should at least learn not to drive side by side and if you aren't passing then follow. I might try to fight the screeching tires and try to get driving school on the speeding or something, but yeah I'd be careful about how much you argue.
Add: your friend isn't going to be a very good witness when he got the SAME TICKETS and the cop will say that he caught you side by side. Actually using the friend may just get you busted for racing. |

Do it. It will be the cop's word against yours, but you also have your friend who can testify as a witness, so you've got that going for you. Make sure to plan out what you are going to say though and possibly leave out the part about the radar detector as that won't hold up in court.
Focus on the fact that the officer said he pulled you because he got complaints about street racing, then gave you tickets for speeding.
In all honesty I would bet that the reality of the situation is that the cop saw you guys, thought you were racing and wanted to give you a scare so he made up the bit about the complaint. If that's the case you will likely lose, but it's worth a shot. |
