2007 Hyundai Sante Fe Broken Tie rod?

A friend of mine was driving his 2007 hyundai sante fe, going about 2 mph down a street, when his tie rod broke on the front right wheel, pulled him into the parked cars on his right, obviously causing a collision. When i went to hyundai to discuss whether or not they would fix the car under the warranty, the guy working there rudely stated to me that first he has to charge a $110 diagonistics fee to check out the car, then he said even after that we could be found at fault for the tie rod breaking and we have to pay to fix it. Plus he also stated that it was probably our fault because that doesnt happen just like that. The car is currently getting fixed at another shop, with his insurance company taking the fault.
Now my question is should we take legal action against hyundai? is it worth?
Also, There were no pot holes in the street, the car is a year and 3 months old, how could this have possible happen? even the guys at the shop that we are fixing the car at, said this doesnt happen on a car this new.

As per the first response...The thing is the car is in a shop already getting fixed, because we didnt want to pay hyundai the diagonistics fee, because we figured everything would be covered under the warranty, so we did it through the insurance.

Anything can break and you need to call the Hyundai customer service department and ask for the area zone manager to come out asap and look at this and you should pay anything for the repairs....
