3-way Intersection stop signs on all three roads left turning lane does not have stop-line whose right of way?

It is a 3-way Intersection. All three roads have stop signs but there is one left turning lane that does not have a stop-line but all the right lanes have stop-lines. If me and a driver start rolling up about the same time and I happen to be in the left turning lane and I do not stop because of no stop-line am I the one with the right of way? After pulling into the road that happened to be a parking lot I pulled into a parking space and the driver pulls beside me into a handicap spot. The car is never turned off but it is complete stopped. My question is did I have the right of way and is the driver at fault for parking in a handicap parking space without being actually handicap?

You have to stop even if there is no stop line; all you need is a stop sign. To be safe, you ALWAYS stop before turning anyways. As a general rule, if you pull up to a stop at the same time as someone else, the person going straight, or to your right has the right of way. Did the driver have a handicap plate or mirror hanger? If so, the driver had every right to park in the handicap spot.

You always need to stop and or at least slow down first at any intersection, this is just what is called the rules of the road. |
