If a boss makes 4 of you go to site in 1 van, i.e. 3 in the front with seatbelts then 1 in the back with the tools and equipment, surely this is illegal ?
Who is at fault, the boss, the driver, the person in the back or all ?
If the van was to be stopped by the police what would happen and who would be charged ?

The driver, its always the driver as he is in charge of the van, the boss would not be charged so if its you, you need to speak to your boss and get it stopped, the police are checking white vans a lot for illegals so they will get you. |

The driver and passenger in the back are totally allowed to refude to do this even if the boss demands it! |

Yes that IS illegal and your boss should be told this. If the Police stopped you then the driver would get the points |

I think the driver would probably be held to blame. I appreciate the boss ordered it but I bet they then deny it. If you were involved in an accident the insurance would be invalid |

the driver is responsible for the safety of passengers, and the company is responsible for providing the means to do the job (a bigger crewcab van). |

Yes it is illegal and the driver would be at fault for following the bull headed boss.
Remember that the number of seat-belts should always equal the number of people that can ride in any vehicle. |

All the answers above have their good points but the one thing that I`d be really worried about would be what would happen to the person in the back if there was an accident?
Being in the back is bad enough,being in the back with tools flying around would be a nightmare.Health and safety at work and common sense say your boss has no right to ask you to put yourself at risk. |

A few things to consider...
The driver is driving with an unsafe load or number of passengers unsuitable for the vehicle. (£30 ticket or £60 ticket with 3 points).
The vehicle would not be insured correctly so there is always the driver driving without insurance, vehicle gets towed under S.165 Road Traffic Act.
Fourth passenger travelling without a seatbelt (£30 ticket).
If the driver (employee) is driving without insurance then the boss will be either permitting or causing him to do so and the boss will go to court!

Yes it is illegal, your boss holds some responsibility but it is down to the person in the back to refuse and they would be the one who was charged, they would pay the fine, but ultimately would be worse off if the vehicle was involved in an accident... if your boss threatens that person with their job for not going in the back where it is not safe then he can be taken to a tribunal. |

It would depend on your State or Local laws. In Ohio, it is not illegal to ride in the back of a cargo van unless you are 4 years old or younger in which case that child would have to be properly restrained in a child safety seat. Of course, common sense should prevail. |

This is illegal and it is the driver who will get the points and the boss fined. Also if they were to have an accident and the guy in the back was killed, the boss and the driver could go to prison. |
