I had the screaming abdabs and made him stop the car there and then. We'd been taking rubbish to the skip and it got in with me. Well, I'll stop rambling, but would my husband have been prosecuted if I'd made him crash the car? He wasn't very happy with me.(It was big though)

I had exactly the same thing and my husband pulled off the road and the spider was safely ejected. When we got home though and the car was parked I closed all the windows and sprayed the car and boot with insect spray in the hope that what had been taken to the tip but stayed in the car would meet its untimely end. I usually try to put spiders outside but in this instance a spider falling unexpectedly on the driver could cause a nasty accident. I saw a TV programme about such occurences happening in Australia and it is apparently quite a problem there. |

Yes, if he crashed the care because of the spider incident he is responsible no matter what. |

Of course. Any accident would still have been his fault, legally, as one is expected to maintain control of the vehicle at all times. |

Yes. He is at the wheel any in any event he is responsible for where the car is.
I can sympathise. I was driving along a busy motorway many years ago when the Sun suddenly appeared so I pulled down the Sun visor.
The fattest spider in the world ran down my hand and up my arm as I tried to climb into the back seat.
I had crossed 3 lanes and had carved a gap between a couple of lorries to come to a tyre smoking halt by the time I regained my senses and leapt from the car on the hard shoulder.
Funny thing was, spiders have never bothered me but the surprise was a total shock, and I still have to drop the visor very carefully if I use it now. |

It depends on how you mean prosecuted
Had he hit another car he would probably been liable to them
If you are asking about damage/driving offences that the police would have considered prosecuting on.......there is a defence called 'automated' response for such situations.
It might have stood |
