Alright here's my story i was pulling into a parking lot right and i saw a parking spot which was pretty big, i saw the door opened a little bit and the daughter of the car saw my car coming in so i stopped real quick and i thought she would pull the door back, as i was pulling in half way in the door of the other car got stuck on the back side of my car and i only got scratches on my car while she can't open or close her door. SHE said it was my fault when it wasn't or it could have been both of our fault cus if it was my fault then the door would have been broken off when i pulled in AND the door wouldn't get stuck close to my back wheel on the drivers side it would be stuck more towards the front.

A person is always responsible for opening their car doors. They are required to check for any oncoming traffic where ever it is. If you get your door taken off in traffic, you can receive a citation for it. It is the same as a rear end-er accident, unless there is proof to the contrary, the person behind is responsible. It sounds like it could go 50/50, but I think the other car is at fault for not shutting the door, which would have been the common thing to do. But then again, you probably should have waited until the door was shut before pulling all the way in the spot. But since the spot was wide enough, I don't see how you would have hit that door unless they opened it wider while or after you were pulling in. If that's the case, then it's their fault.
If the damage is done to your back driver rear wheel, then that's the case to make to the insurance companies. If it was your front wheel, different story because it'll look like you hit it. But back wheel, makes it their fault. |

You stopped, giving the little girl the impression that you had yielded to her the right to get in/out of the car. Why would you think she would pull the door back after you had given her permission to not?
