Advice? Told I should SUE after Loss of steering, almost crashed Today, after dealer said it was Safe!?

Yesterday. I heard a piece of metal bounce of my tires, pulled over and picked up a car piece off the road. It was circular metal with a rubber donut shaped piece attached. I Wasn't sure if it was off of my car, so I took it to the dealer i bought the car from. I told him to make sure it didn't come off my car, he took it in back and showed the mechanic and then assured me it didn't. He said all is fine. I had this car at this point, for one full week. So, today, i was driving and when I turned the steering wheel to the left, I heard a loud metal noise. After this, I had troubles turning the steering wheel. I immediately, called the dealership again. I explained exactly what happened and that I had my three year old daughter in the car with me and told him I didn't feel safe to drive the car. He told me to drive it anyways, it was safe. He said he'd tow it in the morning and it would probably be a quick fix. So, I left tonight for work and lost all control, the steering wheel turns 360 Degrees, all the way around completely loose, and the entire (steering Axel rod?) was on the ground. I was very lucky I didn't crash and we had a heck of a time getting the car parked with no steering. I'm not sure what it is but The Axel connected to the wheels was broke in two places (at each wheel). The piece he said didn't belong to my car did, is similar to another piece that I see underneath. I haven't contacted the dealer again and as of now the car is sitting in a parking lot. I've never sued but 3 people told me I should including a police officer who helped me today with the car, he said I could have been killed, or worse, my daughters could have been. I'm not sure what to do or think, Please advise.

You felt the car wasn't safe. They were GOING TO TOW IT. They told you to drive it anyway. Now here is where towing it becomes interesting. Towing is expensive. If they were towing they were paying. Why didn't they offer to come pick up the car and drive it, or ask if you'd let them. That way they'd have the car and the keys and all, over towing it. Yeah not likely to happen, but to me it would make me question if it was safe to drive. You assumed a lot of risk when you thought it wasn't safe but listened to the dealer OVER YOURSELF. Just realize I'm talking about the way I see it, and that could mean the way a Judge would see it. The dealer would be about 60% responsible to me, they failed to truly check the car(looked at the part ACCORDING TO YOU, not the car) the first time. They told you it was safe to drive the second time you spoke. You put risk on though. You HEARD the loud metal sound when turning the wheel. You felt the car was unsafe the second time you called. You listened to them over yourself and drove the car after that.

Oh the first person telling you to sue for grief for what COULD have happened is the one causing the problems in this Country. You should sue for ACTUAL damages. I think I'm going to sue the lottery because I COULD have hit the powerball Jackpot if I had played and my number came up. That's basically what they are talking about doing. Well this COULD have happened so you should be paid for it. Well you COULD have been killed as well, and so I guess you should sue for nothing(because you could have been dead right?)

document everything and take pictures of the broken parts.

Before you decide to sue, I recommend that you contact the dealer and give them a chance to repair the car. Did the car come with a warranty? If not since you have had the car less that a week, try to get the dealer to cover the cost of repair.

You may want to check if this type of problem has occurred before with your model of car. Was there a manufacturer's recall to repair this problem? If it was a used vehicle did the dealer have knowledge that the car needed repair.

If the dealer is unwilling to repair the car and you think you need to sue, then seek legal advise from an attorney.

Personally, any person who is willing in any way to risk the safety of any other person deserves the ride a lawsuit would offer them. And make sure they pay lawyer fees and court costs. A good figure to begin with would be the price of grief counseling for 50-70 years from losing your child due to their inherent ignorance. Thank heavens that is not a reality.
