Air bags didn't come out...can i sue?

my dad got into an accident today. what happened was he was going around a turn and slid on black ice and went straight into a parked car and hit the back of the parked car with the front of his car at about 20-30 mps. and the airbags didn't deploy, my sister got whiplash and hit her head. Can we sue the car company because the airbags didn't deploy

Right or wrong, if you're in the US, you can sue pretty much anyone for pretty much anything for pretty much any amount of money, so I guess the answer would be yes.

But I'm not saying you're going to win nor even that it's a good idea.

no. obviously, your dad wasnt taking precautions due to the weather conditions because obviously it was cold and icey. airbags RARELY misfunction. it is a very slim chance that the airbag malfunctioned. cars are built so that the airbags will deploy under exact specified conditions. apparently, the conditions, and the impact werent right at the moment. im sorry about your situation, but just because something like that happens, you shouldnt think of just getting back at somebody.

1) there isn't anything anywhere that states the airbags will deploy in an accident. They are only DESIGNED to deploy when several parameters are met in an accident.
2) if they DO deploy, there isn't anything anywhere that states you won't get hurt in a crash.
3) you don't get 'whiplash' in a frontal collision.
4) you can sue anyone but the carmaker will show up with six lawyers and a dozen engineers IF the judge doesn't toss out the case in the first two seconds.
NO one has ever won a lawsuit for this.

No you can't. This is because the car wan't going fast enough for the air bags to go off. The airbags will only go off if it is a solid hit that stops the car abrubptly.

yes, that is a safety feature that should always work, unless you have a switch, and if its defective then the company should definately compensate you. you should have the best luck in court, good luck!
