Of course they are, unless they are stupid. There would be a lot less pedestrian deaths if they took that responsibility seriously.

Of course they are. And let's put to rest, for once and for all, the myth that pedestrians always have the right of way. No such law exists. Pedestrians are required to use the sidewalk when one is available. They are required to cross within a crosswalk -- WHEN IT IS SAFE TO DO SO (ie., they are not allowed to step into traffic, crosswalk or no crosswalk) and when a crosswalk is available. They are required to obey traffic control signals. When there is no sidewalk available, they are required to walk facing oncoming traffic. When no crosswalk is available, they are to cross at a nearby intersection. If there is no intersection nearby, they are required to cross the road at a right angle. |

really depends on the offense committed by the pedestrian, sometimes peds will be cited for their actions contributing to a collision |

Yes, but so are drivers. If the pedestrian was within the law, then the driver has the burden. For example if a person crosses a street where there is a crosswalk at the nearest intersection, but he/she elects to cross somewhere else then they are responsible for damages/injury. However if that person was crossing in an area where there was no alternative but to cross in an unmarked area, then the responsibility results could be quite a bit different. |

Unless otherwise legally not responsible. For example a child of two or three years old or someone legally insane. In California an underage youth who deliberately commits a crime the parents are held responsible. If you are of age and step onto a street against the light and cause an accident etc. |

it depends what their actions are. most of the time, they have the right of way, but they still need to be alert. pedestrians can't predict what a drive will do or if a driver is paying attention. drivers need to be careful also, but if a pedestrian wants to remain safe and alive, they need to look both ways and proceed with caution. |
