Just had a schoolboy on a sixty mph road stroll out in front of me and when asked why he said he liked listening to his music.
Here in the UK should pedestrians be held responsible if they cause a road accident.
I know that if I had hit him I would not have forgiven myself even if it was not my fault.

I totally agree with you on this one, pedestrians should be banned from walking around the streets with earphones. They are so busy listening to the music (well they call it music I beg to differ) they bump into you and never say sorry. They then walk out into the road and expect every car/bus whatever to stop for them. When they cause an accident they should be held responsible.
I would also like to see something done about youngsters on bikes, they ride along the pavement and then come out into the road and start using the road. They never look for other traffic, but if you hit them in your car, you are to blame. |

People should cross at crosswalks or at traffic signals and should look both ways. And yes, if the pedestrian is crossing the street, he/she should have the ear buds pulled out. In a case like this, the kid should be fined with a ticket (if the cops are around). |

Last year, my uncle was riding his motorcycle home from vacation with his family when a man distracted by a cell phone hit him head on and killed him. He had a loving wife and 3 sons.
With people walking disstracted by technology, they should be held responsible but the driver should have also been going the correct speed in order to stop in time. If hit, I'd say both are to blame. |

It's an interesting point and you're incident makes it seem a good idea, I know what you mean exactly about never forgiving yourself, even if the cause was purely unawareness. I think that pedestrians shouldn't be banned from having headphones on, but should have to take them out to cross roads and always stay aware with traffic, that's what I do. x. |

That's a tough call. You cannot suspend a pedestrian's walking permit. Would you want to place a fine on pedestrians for that infraction or just reduce liability from drivers who may hit them? Really tough to enforce and do we want to go around using police to enforce this if it is passed into law or do we just legislate another hollow law with no teeth?
I understand how you feel but maybe this along with other accidents is how we keep the population explosion down... Rough comment to be sure but...

This, in my opinion, is absolutely an issue of a retard, not an issue of headphones. How many people do you see in cities, wearing headphones and doing just fine with traffic? Many, many people.
Unfortunately, we can't save one or two stupid people at the expense of millions. That's just not right. If we do that, we'll be living in a world that resembles a jail, unable to do anything. Where will it end? |

Very good point you made there. A lot of kids these days cycle on the road with there mp3 players blaring into there ears and they would not hear a car coming if they were not looking. Yes, now that i think of it, i think youshouldn'tt be able to cycle using earphones. Not so much walking tho. |

I think they should be. I always take my earphones out when approaching a road as I hate not being able to hear for approaching traffic.
I can't stand when school children, Who are the absolute worst stroll out into the road after school like the cars are going to stop fro them or something. Like chickens roaming out into the road unaware of the danger they've just put themselves in. |

It would be a terrible thing to live with whether it was his own fault or not, people need to start taking responsibility for their own actions rather than blame society and the likes.
It probably starts when, as kids, they play around and fall down a step, then the mother picks them up and slaps the step saying things like "naughty step hurting you like that" when the step has always been there and the kid needs to learn to look out for itself.
Then the blame culture begins and continues and it's everyone else's fault bar their own.
Edit: on a 60mph road the speed limit is 60 mph, there shouldn't even be anyone able to walk alongside it should there for just that reason?
Edit @ noitall Yorkshire England (U.K.): so you think that just because you are a pedestrian you don't have to look where you are going and can walk out in front of a moving vehicle and it wont be your fault but the drivers? Odd! You clearly don't know what hte courts think as your assumption is way off the mark.
Edit 2 @ noitall Yorkshire England (U.K.): in that case hand your licence in and pick up your bus pass as you just don't know who would walk out in front of you, some even do it intentionally and some for fun to prove how 'hard' they are (not 'harder' than a car, but there you go).

No, mobile phones distract motorists as your focusing on the conversation and not what's happening.
More damage is going to be done if your doing 60mph on the road whilst not paying attention because your on your phone.
The kid = dead.
Anyway, shouldn't be banned but a few people do need to pay more attention even pederstrians.
Because the last thing your going to want is to explain to the kids parents when they come up to you why he's dead, headphones. |

If you had hit him it WOULD have been your fault, you must drive according to ALL road conditions, be able to STOP in distance you can SEE to be clear, anticipate the actions of ALL other road users no matter how ridiculous those actions may be, sixty MPH road is a MAXIMUM speed limit, you don't HAVE to go that fast.
Obviously the persons giving a thumbs down think car drivers have the right to mow down pedestrians, I know that the courts will think differently!
