The law varies place to place... many laws use 4' 9" as their 'magic number'. Many states also have an age *or* a height that you have to reach so that shorter teens and adults are exempted legally from being in a booster. If you add your state I can find the law for you.

However... it is important to note that safety wise *fit* is more important than *just* height or age no matter what the law. A child should be in a booster till they can pass the '5 step test':

1. Does the child sit all the way back against the auto seat?
2. Do the child's knees bend comfortably at the edge of the auto seat?
3. Does the belt cross the shoulder between the neck and arm?
4. Is the lap belt as low as possible, touching the thighs?
5. Can the child stay seated like this for the whole trip?

Most children pass between 8 and 10 yrs of age. Those with children destined to be very short teens and adults may simply have to decide when it isn't practical for them to be in a booster anymore... but it is a case where you would be *chosing* for your child to be less safe than they could be... so I would hold off as long as possible hoping to see the test for a proper fit in an adult belt alone *passed*.
