My brakes just went out at a red so I pulled the e brake and went into the intersection but I think the camera flashed me so i suppose I got a 125$ fine coming Its a brand new car and the brakes went out? I cant afford another ticket I'm sure the camera recorded me skidding in the intersection because of the E brake should I fight the ticket take it up with the dealer ship or what? much help appreciated Additional Details The breaks worked after I pumped them for a minute at another red light just worried about the ticket

best bet is TO fight the ticket. state what you have here, and do a bit more research about "Red light traps" and whatnot...
as i heard, its wise to fight a ticket, no matter what. you have to ALWAYS pay a court fee, and a bunch of others, along with the ticket. and your ticket price can never increase.... so.. if by some disgusting miracle, you're able to prove yourself "not guilty," you get out of paying all of that....
i would suggest taking it to the dealer, and having them check out the car... maybe if you can... ask them if something with the ECU can help you out... as the ECU is used to track everything your car does... (Your car's computer...) |

If the brakes really went out on a brand new vehicle, then #1 the brakes are under warranty and should be fixed before you drive the car. Once that is done, you will have documentation from a certified repair shop that the brakes went out. #2 take that documentation to court and beat the ticket. #3 go to court without that documentation and pay the fine and let the judge tell you that you must think he's stupid. #4 pay the ticket by mail and go on with your life.
That's your choices, but if your brakes really went out, you would have already been back to the dealership, you wouldn't be on Y/A asking this question. |

What you should be worried about is whether your brakes are going to "go out" on you again at another intersection, and this time kill you or somebody else.
While you are worried about the (another?) ticket, get your brakes fixed - AND if you go to court, I'm sure the judge is going to ask you if you did get them fixed, what was wrong with them, where the receipt is for the repair, etc., just to make sure that you aren't just making this story up to try to beat a ticket.

The only way that a "brakes went out" defense will work in court is if you bring a mecanic's record that they actually found something wrong with the brakes and they have been repaired.
And, since it is a new car and under warranty, there is no excuse for NOT taking the car in for inspection and repair.
If you HAVEN'T taken the car in for repair, then you shouldn't be driving it AT ALL. If they mysteriously went out then, they can "go out" again at any time. Either that, or this never happened as you describe it at all. That's the way the judge will see it. |
