YES you can.

However, the state is looking at the stealth tax for driving without due care and attention while using the hands free.

But dont worry, its virtually unenforceable.......unless you were in phone contact at the time of an accident...so just dont crash!

Although some suppliers say you can drive while using a hands free kit, other road safety groups will still say you're distracted from driving, so get some advice first.

You don't say where you live. In the UK it's currently legal to drive using a handsfree phone kit but that's not because it's a good idea, it's because a law against it would be difficult to enforce.

Here's a recent US view:

'Rae Tyson, a spokesperson for NHTSA had this to say "We've evaluated and come to the conclusion that hands-free use is just as risky or perhaps riskier than hand-held phones because it's the cognitive distraction that can compromise driving."

and here's the view of the UK's Department for Transport:

Mobile phones have many benefits. They provide security and can be a great help in an emergency. But tests have shown a driver cannot help being distracted by a phone call or text message. If you are distracted, you will not register hazards or react quickly. A conversation on a hands-free phone is no less distracting than using a hand-held one.

The problem with cell phones is not that your hands were previously engaged, it's that your brain is. There is NO DIFFERENCE in the DUI-like reaction times in cellphone drivers whether they were using a hands-free phone or not.

Do you even notice the people that honk at you when you almost hit them? If not, then you are still inattentive when driving.

It might vary from state to state. I know that in Illinois, you can use a hands-free system without a problem, but I don't know about other states. Looking at it from another perspective, some people say that it's not holding the phone that's a distraction, but just talking on the phone in general. If you check with the DMV, they could probably give you a definitive answer.

the law itself does not go into effect untill 2008 anyway so talk on your phone close your eyes do your make-up whatever or start now and get plenty of practice now for the eventual law change
