i got in my car, drove to the end of the road and stopped, wanting to turn left into a main road, i look right and there is traffic coming. so i wait, while waiting a car parked in the main road on the left has just reversed into me trying to reverse in the side street i was in. he hit me with a bit of a bump.... my guess he was reversing at speed concentrating in his right hand mirror to get in before the traffic passed........all the time i was stationary.... heres the twist i have no insurance..... i am a bad person or i have been a bad person and i now have insurance.....(i know its wrong). please guys and girls honest opinions please or some one with some legal advice would be much appreciated.
thanks very much Additional Details its not his car its a company fleet car...he has also told his insurers that i pulled out and hit him while he was reversing around a corner. however he failed to mention that he was reversing off a MAIN ROAD- isnt this illegal .
i have contacted a legal company on no win no fee basis specialising in road traffic accidents.. and also plan to sue for his bare face cheek blaming me for the accident ( i was stationry) for personal injury, the think i have a case - he shoudnt be reversing on a main road.
I am fully insured now people i know its too late for this incident, but i intend to stay legal and road orthy now on.

Hes at fault, because you were waiting at an intersection trying to turn left. It is his fault because he hit you and not the other way around.
When the insurance company looks at your car, they may find a scratch or two on your fender. Not having insurance is a bad thing, but in this case you are safe. The person who hit you will be responsible. |

i am sure if you report this incident...you will face charges for no insurance...i would let it go if it were me...& NEVER drive without insurance...hope this has taught you a lesson!
No win no fee people would say you have a case...but honestly beware of what you wish for...once his insurers realise you were uninsured...you will be in bother...not worth the hassle if they sue you!! |

He's at fault but nobody's going to care cuz if you take it to court, police, insurance whatever they'll toss it most likely on the basis that you shouldn't have been driving |

it's definatley the other person's fault. you could totally fight a ticket or a fine or whatever. get a lawyer if it's needed.

He is at fault, so his insurance will cover all the costs. Usually your insurance would do all the paperwork for you. Get insurance! There is no reason why you shouldn't have it. |

It sounds like it's the other guys fault. Was anyone given a ticket? Is there a police report? Are there any witnesses? Is he expecting you to pay for the damage? How did you leave it with the other driver? If it's considered 'no fault' you both will have to pay for your own damage. If he has insurance his will pay. If you don't have insurance you will have to pay out of your own pocket. |

Im an insurance broker.
The other driver would be at fault for the accident as he was backing up.
Depending were your located. i'm in Ontario. His insurance would cover the portion of his damage. Depending what kind of insurance he carries (Would need Collision on his insurance)
Since you don't have insurance you will not be able to get your automobile fixed through your insurance. You will have to pay for the damages out of your own pocket, unless other driver pays for it.
If the police were contacted and a police report report was filed then you should of been charged with driving with no insurance. This conviction will stay on your record for 3 years.
Once you decide to purchase insurance, which you should do, this conviction will affect your rate.
Hope this helps... And get insurance now.. You might regret it later on if you get into a more serious accident. |

This is a tough one since the police were not called. It is essentially your word against his and if he lies then you are in big trouble.
I hope at the very least you have an impartial third party who witnessed the accident and is prepared to say that the other driver was at fault.
Essentially if this goes to trial, then blame has to be proven and since you both have reason to lie, unless you have evidence then the court may go either way.
It is essential you get get legal advice as without insurance you are personally liable for any damages. It is essential that the case goes in your favour otherwise you could be stung for a lot of money. If you are going to one of those no-win, no fee solicitors make sure they have the full facts, because they should be able to advise you on what they can do.

If he was reversing he's at fault, but you may have a hard time proving that he really was reversing.
Now you know why it's really dumb to drive without insurance. |

It appears you are NOT at fault but I'm not sure how the fact that you don't have insurance will factor in. Your best bet is to try to deal with the other party amongst yourselves as long as he/she's being reasonable. |
