Don't worry. The insurance companies employ a legal team for this very reason.

Your insurance comp will decide if she's telling porkies. If they say the fault is 50/50 and your sure it's her fault, go to court with it - I did and won.

You have to give her your insurance details by law, and they will find out the facts.
So long as it's genuinely not your fault you should be fine. |

If you dont give details you can get into more trouble.. if someone saw it and they talk to her, your screwed...Even if you give your info go to your insurence company 1st and explain what happened.. someone hit me once and said it was my fault but i talked to my insurence first and the other person tried to say they got whiplash, they were spotted at a les schwab next door to my insurence company.. Answer... GIVE UR INFO BUT CONTACT UR COMPANY FIRST..Cuz she could of got your liscence plate # |

No you can give her your details but you can tell your insurance company what YOU think happened, phone your insurance company and tell them your side of the story. You don't just let them claim lol! |

1. Take pictures
2. Call the police
3. Write down what you remember
4. Take insurance information
5. Talk to witnesses. |

Hi mate, first of all don't panic, this is not as bad as you think. When an accident occurs and it is reported to the insurance companies, they both make a thorough investigation into how the crash occurred and want to know exactly what happened. Only then will a decision be made by experts at their end, who is to blame for the crash. If she just said 'it was his fault' they will not just take her word for it believe me! They will want to know your side and they will make the decision themselves. So you could end up coming out on top. So try not to worry too much and I hope all goes well. |

if it was not your fault just get in touch with your insurance company and ask advice.
if she is trying to claim it is your fault it will be up to you to make sure you put your point across strongly.
as long as she hit you she doesn't have a leg to stand on.
bit of a tip find someone to say they witnessed it and say it was her fault.before she does it.
as for your insurance going up it will go up next premium when you renew.if you have made the claim. |

You must first report the accident to your insurer. If you do not you may negate your cover.
They will take a statement from you and send out an assessor to look at the damage to your car.It is in your insurers interest to defend your position.
report the accident to the police.
you must give your details to her.
if you are injured go to your doctor as medical evidence is important if you claim for personal injury.
get details of any witnesses to the accident
take photos and do a sketch of the accident scene (google earth is good for the sketch) and map for your insurers,
Your premium will only go up if you are found to be at fault. So you must inform your insurers now! |

i do law and if it gets really serious you could take her to court and they can do checks to figure out exactly how it happened and sort if for you... other than that i don't know what you can do which really isn't fair |
