Car Crash open door, who's at fault?

If you are driving and another driver opens their car door (their car was parked) and you hit the door, who is at fault? You or them? Especially if there is no way to stop your car or else cause a pile up. Some lady opened her car door as I was driving and I could not stop, because I had ten or so cars behind me. I couldn't swerve into the another lane because it was only one lane on a two way street. Had I swerved I would have had an oncoming collision with the other cars. She shouldn't have opened her door! It is the responsibility of the person opening the door not to open it into traffic. It is their fault in all 50 states in the USA. Glad no one was hurt.

This is 100% the fault of the person who opened the door into a traffic lane.

You are required to keep your vehicle in full and complete control at all times. You struck the vehicle. You are at fault. If it had been a small child that ran out, would you try to blame them?

You struck a stationary vehicle. You are lucky that no one was physically hurt. You should not be traveling at a speed that will not allow you to avoid hitting something.

You are 100% liable for any and all damage.

You didn't provide enough info about the situation.

For example, I've seen someone open their passenger door, and someone was driving on the shoulder, to try to pass. In this case, the other driver was completely at fault.

If you're driving down a small two lane road, and there's parked vehicles on both sides.....you're responsible to maintaining a speed that allows you time to stop in case of such a situation.

Just as she's responsible to check first.

In which case, it's 50/50 fault. And all those cars behind you? That doesn't give you any excuse for not trying to stop. It's their fault for following too close. That doesn't excuse you from your own responsibilities.

It's a no win situation. She should have looked. You should have tried to stop. The people behind you should have given you more space.

well a women swerved into my door because she was goito fast into a parking space and didnt see my door and blew it off the hinge and shes claiming i opened it out on top of her..
