I was driving at approximately 25-30 mph when a street light up ahead turned yellow. I was going to go for it when it turned red and decided to stop. I guess the stop a somewhat abrupt and the person behind me hit me. When I got out of the car, I noticed that my car was way past the white stop line on the road. However, I think that the car behind me pushed me forward a bit so I do not know if I actually stopped there. The person said that it was my fault because I just stopped. He said that I should have just kept going. The person must have been traveling pretty fast because both of his air bags deployed (local street) and the front of the car was pretty much done for. Luckily, my car left with just minor scratches. My personal feeling is that it was his fault because he was obviously tailgaiting me, traveling at a higher speed, and assumed that I would cross the road. Though, could I be liable for choosing to stop? Would the area where my car ended up make it seem as if I break too late and that I should have just gone through?

It was red when you stopped, and they said you should have kept going, meaning they planned to speed through a red light as well. That's another issue though. It is their fault. If you had called the police, like you were supposed to after an accident(and really supposed to with that much damage) then they'd see how bad the damage to the car behind you was and they'd get an idea of how fast the car was going from the scene. At that point they figure that you were pushed some, based on how you make it sound. How much of the car was past the line though, most people pull a little past it. Even if it was just the front tires no one would think anything of it, except that you probably should have stopped sooner because you were getting close to the intersection. The other driver is at fault to get to the point though. |

Sounds like he was trying to going for it too. It was kinda of bad for you to give him idea that you were going for it and change your mind, but it was his duty to follow the traffic device and not you. So in the end, it was his fault for failure to obey the traffic device.If he had, he would have already been slowing down and coming to a stop which would not have impacted your car. |

In most states the car that hit you in the rear is at fault for driving to fast and for being to close (tailgating)
ESPECIALLY at a yellow light. |

It's always been a standard that the person at fault is the one who hit someone from behind. The argument is that no matter how fast you stop or how out of the blue it is, they should keep a safe distance from you at all times. Always giving themselves enough room to stop without hitting you. |
