Car accident where i rear ended a lady who stopped in traffic for no reason?

so i was driving home from a concert yesterday with a friend, there was a lady being very aggressive driving on the highway, i didnt pay attention too untill she went around me and cut a car off to get on an exit ramp, i was already in the lane to exit so did, stopped at intersection and went came to a red light with the aggressive driver next to me on my right, light turned green we both went next light red stopped. she was in the lane that must merge into my lane, well she ran the red light to supposedly get in fron of me which she did so i went when the light was green and got over one more lane to my left so i wasn't right behind her as i approached her car she cut me off and i honked my horn she then slammed on her brakes causing me to hit her, hard! she had no reason to stop in traffic there was no one in front of her and i feel she slammed on her brakes wanting me to hit her. i got a ticket for failure to control speed at an accident, and i want to fight this. what do i do???

the only reason i was to close was because she cut me off i was in my own lane untill she cut me off.

You have a valid defense. When she moved in front of you and stopped suddenly for no reason, that is reckless driving. Unfortunately, it will be your word against hers.

If you had solid proof, like video from a traffic camera, I would sign traffic complaints against her and also sue her for deliberately damaging your car. In some state this would be considered an assault. Without that type of proof, it is your word against hers.

unfortunatley there is a driving law that says the person who rear-ends someone is always at fault, even if it really was the person in front's fault. i suppose you could take it to court but the lawyers fee would probably be more than your ticket was anyway,

Sorry hun. If you hit her from the rear it's automatically your fault. My friend got a ticket when a car banged her as she was making a left turn. The other driver didn't have his head lights on so she couldn't see him coming. On top of that he didn't have a drivers license. He got away with nothing. Just an example of how unfair the law can be.

Whenever you hit someones car from the back it is your fault. This situation sounds like a little road rage on both driver's parts. You SHOULD have gotten as far away from her as you could. An aggressive driver like this is just asking to be hit so they can claim injury and sue! That is their motivation in the first place most of the time. It becomes YOUR fault because you allowed her to control your behavior, because you allowed her to get that close to you and because you were not in control of your vehicle. If you're both in the park and it's just a fist fight, that's one thing, but when YOU are in control of a one ton killer, it IS your responsibility to control the machine as well as your temper. Lawsuits like this are the primary reason we ALL have to pay so much in insurance premiums.

This is crazy. I just hope this never happens to me. Law is screwed up. Especially that story of where the other driver had no license and got away with it. That's simply screwed up.

Unfortunately it sounds like she was fishing for an accident claim and you feel victim to it, rear ending is always deemed the fault of the person hitting from behind, if you have any witness you may be able to fight it, and if she has a history of being hit from behind, then there may be a case, but it may cost alot to prove and may not be worth it in the monitory since but in principle , as in taking a insurance scam off the street it would.

Road rage is never an excuse to slam into someone's rear! You need some anger management.

Learn how to put enough stopping distance between your car and the one in front of yours so you don't cause an accident! FIGHT REAR ENDING SOMEONE? good luck, unless they were in reverse and you were parked. How do you know she had no reason to stop? You had no reason to be driving too close to her and cause an accident. She could sue you for your whole policy if she was injured. Worry about your own driving skills and get away from people that are "dangerous". especially when you hardly have the skills to judge and control your driving safely.

I agree with all above me on this. You are at fault because you hit the car from the rear. This is not automatic in every case, but to get out of it, you will have to go to court with witnesses who saw the accident and can confirm she 1) cut you off, and 2) stopped short in front of you BEFORE you had the chance to regain a safe following distance.

This is the reason so many car/truck accidents are the truck driver's fault. The driver of a car does something stupid, leaves no room for a truck, and then stops and is hit by the truck. Without witnesses, most accidents will be ruled against the vehicle which was in the rear position.

Go to court and take your friend with you. I hit a small pickup in the rear that pulled out in front of me, went to court be very respectfull to the judge and you might get something changed

It sad that things like this happen but you will be at fault for what the police will call it "following at an unsafe distance" or "not controlling your speed" as you already know even though in reality is was not your fault.
