Car accident, who's at fault?

I was at a stop sign behind another car, i was able to see the tires of the car in front of me. The car was a little ahead of the stop sign, waiting for incoming traffic to pass by, then it suddenly reversed really fast, right into my car. Is this my fault?

Well right now you are innocent, but only a fair investigation and trial could say differently.
In theory yes, you are not at fault. But also remember; with any accident you will always have a 80/20% fault from the start. The other party will have a defense that you were too close and at least 20% at fault yourself. But you have the 80% to fight and hopefully win being the other person did randomly slam into your car with no reason. Were you issued a ticket yet? If not, I don't think anything will be charged against you after going through court. |

Yes. When coming up behind another driver, you should ALWAYS leave a space between you and the person infront of you, incase things like this happen. He was infront of a stop sign, he could hardly move forward - so you should have made sure you stopped behind him leaving a good amount of space.
To be honest, I would like to hear the other persons side of the story. of course you're going to do all you can to make it seem like the other persons fault - you're not gonna readily give information about how close you were (too close) |

you are considered at fault being the cops see it as failure to assure clear distance. thats also why if people with manual shift cars roll back into you it is your fault. stupid i know |
