Car crash at a T junction Who is at fault?

I was stationary at a T junction trying to turn right. There was a car coming down the road on my right had side. The car indicated to go left into the junction so i came out of the junction and the car did not turn left and went into my car. Is this my fault? or is it the other driver?

It's your fault.
Don't believe indicators. They can be ambiguous - he might be intending to pull over on the other side of the junction. And if the driver has the audio turned up loud they don't know they are turned on accidentally or left on from a previous manoeuvre. |

Somebody told me once that all a flashing turn indicator really means is that the bulb isn't burned out.
I always wait for some kind of commitment before I start to believe the blinker, like the car beginning to turn.
Irregardless, it's all on you in this case. |

Indicators are just that. They are an indication of something, not a definite!
If you had been on your driving test you would have failed for pulling out. You should never pull out until the other car has actually started turning.
You could argue that the other driver should have been paying more attention and slowed down to avoid you but it doesn't change anything when it comes to your insurance having to pay out.
So many people accidentally leave their indicators on or knock them on by mistake. I've done it myself in the past. Some people seem to forget their cars even have indicators. My step father is a driving examiner and he once said to me - when you're out on the road, you're not driving for yourself but for everyone around you. I think it's a very true statement and one that always sticks with me when I'm driving. Besides making sure that my driving is safe I watch what the cars around me are doing and think about what they may decide to do, i.e. when you're in the left lane on a motorway and the car in the middle lane suddenly pulls infront of you with no indication. I'm always aware of what others may do. It works for me, touch wood but I've been driving for over 10 years and never had even a bump. |

Need more info on this one... was this a controlled intersecion? Was there a light or a stop sign? You should NEVER base your judgment soley on whether or not someone has their signal on. Double-check everything... trust no one; not a day goes by where I don't see someone driving down the street with their turn signal on for a few blocks before realizing that it's on or them actually making that turn to cancel it out. |
