Car crash who fault is it?

car crash and whos fault.?
here was a scenerio i got into.
i was driing on a small street and their was a oncoming car going towards me so i pull next to the other parked car so that we can both pass and some guy opens his door a little and i hit it with my side view mirror.
the guy wanted money so i gave hime like 150 now i am thinking maybe it wasint my fault maybe it was his fault and he did not give me any money for my side view mirror.
should i take the money back and file a police report next day?

He could see you coming down the street, you had no way of knowing he was going to get out of the car so he hit you, not you hit him.

Ok where were you when they were teaching drivers ed? You never admit fault at an accident - even if you rear end them! You let your insurance company deal with faults.
By giving him money you accepted fault. You also will never see that money and you better hope you had a witness see you give them the money. They could claim you never paid a dime and still turn it into insurance. Also, don't expect any money back. If you are driving you need to understand the laws of driving. Your ignorance in handling the situation cost you a chunk of money and the ability to let the insurance company determine liability.
I suggest brushing up on your drivers ed class, it could be worse next time.

I hate to tell you --but you was taken--sounds like a scam to me, they were probably settin there waiting on someone to come down the street, If you were not sure who;s fault it was --call the police, and let them tell you who;s fault it was, and how are you going to get you money back from them ? Did you pay them cash? They will probably say they never say you before in their life, and then it will be a she said he said situation, Next time call the police and let them make out a report, don;t get hooked again.

I think that it is a 50-50% deal. You were not careful with the fact that you were not looking around at your surroundings and where you were driving. He is at fault with the fact that he didn't look before he opened his door, he just opened his door. I think that it would be a good idea to go and get a police report,as this way it will tell you definitely who is at fault, and how things should be taking place.

Definitely his fault, it is an offence to open a car door without checking it is safe, what if you had been riding a bike past as he opened it?
Report it to the police, and he should also be charged with obtaining money under false pretences.

Never ever ever admit fault, or do anything that could imply admiting you screwed up. By giving him money, you said 'it's my fault, sorry, here's money to fix your car'. It is his fault though... so try filing a police report ASAP. Any witnesses??
