Contest a speeding ticket?

I need help. I was pulled over by an officer on a motorcycle. That time i was making a left turn and i was shifting from gear 2 to gear 3 on my prelude. from gear 2 the rpm was in 4500-5000. i saw a police officer on my right side maybe 50 ft ahead. he was going to make a right turn. so once i got up to 4500-5000, the cop seen me. i shifted gear, and next thing i know blue and red lights begin to flash. OK here is the info. i was doing around 53 MPH!!! he put 60+ on my ticket. and he made me sign it. he didnt ask me to sign it. he informed me that i have to sign. So i did, and i went on. The area i was doing 53 in, was a 45mph area. HE DIDNT HAVE A RADAR. He asked me my approximate speed, i told him around 45-50. He told me Bull **** and gave me a ticket. He told me if i told him the truth, i would get away with it. I have the court in January 2009. I am hoping for some advices please! What is the best way to contest my speeding ticket in the court?

Well here is the deal with this scenario. It seems to me that both you and the cop were incorrect in your assessment. He was wrong because he put down false information on the ticket. He said you were doing 60+ when in essence according to you, you were traveling at 53 mph. So he was wrong for that. Secondly, you were wrong because you were going 53 in a 45 mph zone. You were speeding because you are supposed to go only 5 mph above the designated speed limit. That is just the law. Now about contesting it, well the only grounds you have is that he incorrectly wrote you on the ticket as going 60+. Other than that you are guilty for speeding. You can contest it, but its really his word against yours and as said you were speeding if you were going 53 in a 45mph zone.

in my expiernece the cop could put down you were foing a 100 in a pinto with three flat tires the judge will always go with the cop. Just pay it or go talk to the da in nc if you talk to the da they usally reduce it.

Your better off just paying it you were speeding to start with and the judge will see that.

goto court and see what happens., you loss or win, if you don't go then you loss

Go to court. Judges look at your driving record. If it's good, he or she may let you off 100%, make you pay court costs, give you probation before judgement, or any number of things that will prevent points from being assessed (and thus keep your insurance premium from being raised.)

Be warned, though: if you have a bad driving record and you go to court, you could have additional fines assessed and even lose your license.

In some states you do have the right to have your ticket reviewed by a judge; this is called "bench trial" and a judge determines your guilt or innocence.

In these cases, your decision is dependent upon the judge and what kind of mood he is in. Some judges hate to reduce or dismiss speeding tickets because it is good revenue.

In other states, you have the right to a "jury trial" which is when a jury hears the merits behind you receiving the ticket and determines whether or not you have to pay the fine.
