Court Question?

I was going 96 in a 70 on a highway in GA. I have heard enough about how irresponsible it was. I know I was being stupid and dont need a lecture. I want to go to court to see if I can get my fine of 704.00 reduced or my points taken off my record. If I go to court what plea should I enter? Not Guilty, Guilty, or No-Lo? I have no citations on my record. This would be my first offense. Is there a plea that works better than others when hoping to get penalties reduced?

Respectfully,

Ryan

Ryan,

I am assuming that you were caught by a traffic radar device. You are not going to beat the ticket. The cost of a lawyer will more than likely exceed the cost of the fine.

Go to court and enter a guilty plea. Explain to the judge why you were driving so carelessly. Point out you have had a perfect driving record in the past. If you are honest with the judge, he may reduce the fine if he buys your story.

Good luck...

nolle contedre is the only option you have but if you have a Public Defender good luck on getting it reduced. In Va that is wreckless driving and comes with jail time. Usually it is not given but rarely reduced to a leeser charge. Be hopeful they do not make you hang out in the big house. Good luck and act really sorry.

Take the ticket to a traffic clinic and they'll prevent points on your record. The lawyer will do it for you you don't have to appear in court. You may have to pay Court cost though.

Do not go to traffic school, that's admitting that you were guilty and your attorney can't do anything about it. Whatever you do do not pay ticket or take classes.

dont make matters worse they could make an example of u with a harsher penalty

in the area i live in, a person can go to the courthouse(clerk of court area) and wait in line to see a district attorney who will often times reduce the speed, for example, he may drop the citation down to 84 in a 70, BUT you have to sign a paper in effect pleading guilty and you'd better have violation fee PLUS court cost in cash and ready to hand it over.
i don't know your age, but if you get points on your insurance, they will sock it to you, for the next 3 or 4 years.
it's cheaper to just pay some local lawyer four or five hundred dollars to get it dismissed.

I'm with Super Freak.

Make a call to the DA's office. They will often make a deal because it will lighten their load on court day.

My husband is a criminal attorney and he charges to take care of these kinds of issues. All he does is makes one call. He often says that if the client knew to make the call himself, he wouldn't need a lawyer. Now, it is advantageous that he knows the DA, and yes, the DA would prefer to deal with an attorney vs. a citizen, but it certainly doesn't hurt to make the call yourself.

You should probably plead guilty and go to traffic school if it's offered. Also, what is "no-lo"? I feel stupid asking, but I'm completely lost. Thanks.

on a first violation they allow you to take a course in safety (at least in the state of Ohio) that costs 250 bucks, for a few hours that expunges the ticket from your record, look into that in your state, there may be something similar, all you would have to do is go to some classes for a few hours and pay 250 bucks. but this can only be done one time

The best thing to do is ask this same question to the court clerk. she could very well help you out.
