Cut up by car pulling in front of me trying to make a turn onto slip road?

travelling down A34 in hants going passed the slip road for the A303 a car pulls in (10ft ) front of me and then comes to a virtual halt and tries to make then turning onto the slip road at the end of the hatchins 10-15 from the grass verge, I have no option but to collide with the vehicle as very busy in lane two with traffic. because I clipped the car that pulled in front of me my insurance say Im at fault. I had no stopping distance watsoever but the fault is all down to me. could anybody pse advise

The police were involved and the driver has been charged with dangerous driving.and there are witnesses

I gather that you are talking about the 'Bullington Cross' junction - a very dangerous down hill accident 'Black Spot'. I drive artics, and have had 2 take avoiding action on numerous occasions due to some retard in a BMW or Mondeo going too fast, talking on the fone, or reading a spreadsheet!!! and wanting to get off there!!! As the police were involved,you should have a crime/ case number, instruct a solicitor to proceed with a claim against the other drivers insurance company. Use the phrase 'The driver "stole my safe stopping distance" by his actions' that is what I was told by a Traffic Policeman when the question came up in conversation . As he caused the accident he is to blame. Insurance companies are quick to take your hard earned, but are reluctant to pay out in cases like yours. What surprises me is that there are no speed cameras at all on that stretch, as there have been numerous serious crashes involving more than 2 vehicles in the recent past

It seems illogical for your insurers not to fight your case when
it appears the police have charged the other driver with a driving offence. You would think your insurers will want to place the blame upon the driver who appears to have caused the accident rather than pay up themselves - by the way are you covered by comprehensive insurance or do you have 3rd party cover only. I would certainly insist that your insurers fight your case and ascertain whether the police report will support your case.

you should have got the police involved ,then you would have evidence to show your insurance. now you have no chance,it,s their word against yours.normally for a rear end shunt,you are guilty,lesson learned,i hope.Allways get the police if it,s not your fault,unless the other driver signs accepting responsibility.insurance companies tell you not to do this,but it can avoid a police charge and points.

Jody W is right. Without witnesses, the law is (unfairly) always going to take the side of the car in front. The excuse is always the same, they say that you should basically expect the car in front to stop and allow appropriate room. It really is an awful law :(

I would ask your insurance company to get a copy of the police report of the accident and then contact witnesses.

I don't understand why your own company is trying to say it is your fault! If they do then they have to pay the other drivers costs! You probably spoke to a YTS operator in Delhi or Calcutta as insurance companies are umbing down on claims staff to keep down costs - a false economy but regrettably true.

you've only got any hope if you have witnesses, otherwise the driver int he rear is at fault, even if someone reverses into you!

If you have a witness then fight it in court. The other driver may even get charged with dangerous driving, or driving without due care and attention.

Additional:
Sounds like he doesn't have a leg to stand on, legally. Fight it through the court (or get *your* insurance company to fight it). His insurance company will do anything they can to not pay up, but he was obviously in the wrong!

if you ran into the back of him it is your fault no matter what he did wrong. YOU RAN INTO HIM you have not got any defence in law. you are guilty of driving without due care.

just seen the addtional details the info I have given no longer applies you now should get a lawyer and as daft as it sounds the insurance company will have to pay if you are covered for legal advice
