DRUNK DRIVING... Who is at fault if you know that youre entering a vehicle where driver is under the influence
|
If you know for a fact that the driver is under the influence, and you conciously enter the vehicle as a passenger, and the driver gets into a crash, and you get severly injured. Shouldt you be held responcible for your actions? (my point being EVERYONE knows that getting into a car with a drunk person is not smart). I am specifically talking about the Nick Hogan case...
I think that his friend KNEW that nick was drunk, and knew that he was going to be speeding, but yet he entered the car. Now his family wants Hogan to be responcible... I just think that the paralized kid (however sad the situation now is) should be partially responcible for his actions....
What are your thoughts?

umm well id have to say its kinda of both there fault cuz hogan should have known not to drink and drvie and his friends should have known not to get in the car. |

The present mind set in this country has virtually eliminated the concept of consequences for ones actions - and the lawyers are a big part of this situation. |

I think the passenger is more responsible than hogan himself if he was sober. He should have stopped hogan from driving. |

That is not even the issue. The way the Hogans are acting is the issue! Hulk saying that it was "Gods will" and the boy is a vegetable for a reason and how Nick is "suffering" in jail. Give me a break! Log on to TMZ and watch the video of a day in the kids life. |

If push comes to shove the passenger could be help partly responsible for the drivers actions.. |

They are both at fault and should share responsibility, but Hogan being a cele-braty also has to deal with the "gold-digging" and "being made an example of" aspects and the situation.
So, he'll be sued for millions. |

Since they were both drinking, both were impaired. Neither making good decisions.
However one chooses to be the driver, that is by far the worst decision. The test showed Nick to not BE drunk by the standard of the law, even though he had alcohol in his system.
He blew a .03, while a .08 is the minimum to qualify for a drunk driving arrest. So he wasn't drunk by the legal standard, only impaired. That's why he didn't pick up a drunk driving charge. Also evidence that the passenger did not enter the car of a drunk driver.
Believe me, that passenger is paying a very high price already. What more do you want done to him?
Nick broke the law by drinking under age. He broke the law again by driving while impaired. He broke the law again by using excessive speed. What law did the passenger break?
So, which one deserves to be in jail? It's clearly Nick. |

I think the owner and driver of the car is responsible for whatever happens when you have an accident. It is you responsibility as the driver to ensure the safety of your passengers. And as the owner to not let anyone drive who you KNOW is young, inexperienced and you provided alcohol for.
The Hogans are disgusting. Hulk Hogan said God did this to that young man. No Hulk, you and your son Nick did this to him. Then they discuss which show will pay Nick the most money when he gets out of jail.
Hulk Hogan and Nick Hogan - I hope he takes every penny you have. |
