Those who say the pedestrian always has the right of way need to actually read the laws.
It depends. If it's at a controlled intersection and you have a green light and the pedestrian has a "Do Not Walk" light, you have the right of way.
If it's not a controlled intersection, odds are your state gives the right of way to the pedestrian on the sidewalk as he crosses the side street, in which case you yield. |

b) The pedestrian has a green light and there is no walk/don't walk sign.
No, if either:
a) The pedestrian has a don't walk sign (a red hand), or
b) The pedestrian has a red light and there is no walk/don't walk sign. |

The Highway Traffic Code in most areas does contain laws for Pedestrians; however, the bottom line is, the Pedestrian will suffer more injury/death if hit by a motor vehicle. Regardless of any impatience or frustration a driver might exhibit, drivers should therefore yield to Pedestrians. Why would any driver intend to injure or kill a Pedestrian? Pedestrians do have the right of way at any crosswalk (which exists at any intersection where two roads meet, whether marked or not). The law in most areas also states that you must come to a "complete" stop before entering any roadway from a back lane, driveway, or parking lot, BEFORE the sidewalk. The laws stand up in a court of law for the protection of the public
When you are a Pedestrian, you tend to become intolerant of drivers, and when you are a driver, the opposite seems to be true.
