If the company assigns them a truck without A/C all the driver can to is complain. A/C is a luxury, not a nessesity, unless of course you are driving in the southern states. Most newer trucks come standard with A/C anyway. There are no DOT regulations about whether or not a truck has to have A/C. |

Uh huh, go on I'm listening
|
there is no mandatory a/c law in public transportation or work vehicles. It's a luxury, not a necessity. |

I don't know about state, but according to the Federal Motor Carrier Safety Regulations handbook, there is nothing requiring air conditioning that I could find, but there is a requirement for adequate ventilation in the sleeper berth (assuming this is not a truck with a day cab) (section 393.76-f),. If there is no louvers back there, they need to fix it, cause the only other ventilation would be the escape door and sleeping with that open would not be safe. He needs to talk to someone higher up about getting it fixed cause more than likely they want to keep a good driver happy. |

I suggest asking for a different truck or changing the company since what this is looks like a complete ignorance towards your hard working drivers by the company. |

I was wondering the same. Today temperatures are around 107, tomorrow 111 & Thursday 112. CAL/OSHA has a heat advisory with workplace standards. Not sure about NY. Does not mention anything about requiring AC.
I guess those Terminal Managers don’t care too must since they are sitting in their air conditioned office. It should no longer be thought of as a privilege when temperatures reach over 100. |

No law says they have to most companies do though. |

The way I was told was that if the truck had air conditioning in it and it wasn't fixed, you didn't have to drive it. Problem with that is the boss doesn't have to keep you employed either! Stinks, but there are no DOT regulations that I know of. |

not sure but my dad use to drive a box truck without a/c and he would have to take his own little fan but know he's a owner operator so i don't know if its changed |

If the truck is a 2003 model or newer and is equip. with a/c it MUST be in working condition or should be deemed Out-Of -Service. |

I checked your NY state laws concerning this and there is nothing that states that this needs to be fixed...... |

Yes! A happy driver is a safe driver. A safe driver makes the company look good and keeps the road safe. |

Do car drivers have a right to have air conditioning in their car if they are a company driver?
Do the writer of this question have a right to have air conditioning in their vehicle if they are a company driver?
There is no DOT or other kind of regulation governing whether AC can or cannot be used. |
