I know someone who just got caught 2mg over the limit, there were at 37 when 35 is the limit! this person was in a small accident, through someone else's fault and not signaling on a motorway! got breathalyzed at the scene but then went to hosp with minor concussion... i thought that you had to have another one when you get the police station before then can do you for the offense? i know this person didn't go to the police station so what happens now?

this person also lost there license over a year ago and only been driving for 10months since so i have know idea what happens next

If blood alcohol was determined through a blood test only one sample is required to determine the amount of alcohol absorption.
If it is a breathalyzer test, two are required over a 1/2 hour period for better accuracy.
And if this is a second offence '''your friend''' is royally screwed regardless of who was at fault. If '''your friend''' had obeyed the law there would have been no accident because '''your friend''' would not have been driving a car. |

If he/she was in an accident and in the hospital, they most likely get the level from the blood work.
If they were driving drunk, and or on a suspended license, it will be "Book um Danno" time.

Actually you don't have to take any test to be charged with drunk driving. The arrest in made in the officers professional opinion that you are driving impaired and the breathalyzer is used as colloborating evidence. |
