Does it really matter if the pedestrian Donte Stallworth killed wasn't in the crosswalk?

One could possibly make the argument that the guy jumped right out in front of the car, but Stallworth's story doesn't say that. And I understand that jaywalking is against the law. The issue, though, is that Stallworth was legally drunk and hit/killed someone. And common sense tells you that if you see someone walking in the street, you slow down or stop. But I guess his judgement was impaired because he was DRUNK.

You're right UCANTCME, I forgot to mention Stallworth flashing his lights. That further begs the question, why not just stop?

IF... you are legally intoxicated >>> YOU are to blame ... it is assumed that if you were not intoxicated you would have avoided the accident / hitting and killing the pedestrian

if you are driving at a safe and legal speed - because your reflexes and decision making would be unaffected by the alcohol, you would have taken the correct steps - whether by stopping or veering around the pedestrian or taking out a parked car to avoid the pedestrian!

Stallworth needs to face up to his mistake and pay the full penalty assigned by law for vehicular homicide and drunk driving.

End of story.

Being a "FOOTBALL STAR" is no excuse for driving drunk and killing someone!

I'm just wondering why he flashed his lights instead of honking the horn. That would have seemed like the better option. Where I'm from, we generally flash our lights to let someone know it's OK to go. Like telling another car to go first at an intersection or that it's safe to merge in front of you. Or in this case, telling the guy to go ahead and cross the street because the car is going to let you cross. I wasn't there, so I don't know what actually happened. It just seems like it would have been better to honk the horn if someone was crossing in front of your car.

Absolutely it matters we put these cross walks and road signs up for a reason, it may be that Mr. Stallworth is at fault but when something as serious as this happens you need to look at everything. If he didn't yield properly to a pedestrian or the pedestrian illegally and dangerously attempted to cross the road probably make it matter.

When you got "MONEY" you can do anything that you want and just today this is what I read......Miami Beach police on Tuesday revealed additional details of the fatal crash involving Cleveland Browns wide receiver Donte' Stallworth, saying the football player told police at the scene that he flashed the high-beam lights on his Bentley to warn a man crossing the street.

But he was still drunk and he should be treated just like anyone else..
