Let me give you some examples:
Say suppose a car pulls out on the road in front of you. You swerve in the oncoming lane to avoid hitting it and hit an oncoming car. The car on the wrong side of the road would of course be at fault. Or if you don't swerve and hit the car in front of you in the rear. Without witnesses, the driver that pulled out in front of you can deny pulling out and because it's a rear end collision, the car from behind would probably be at fault.
Say suppose 2 cars are about to merge on the interstate. There's light traffic. The second car is waiting for the first car to merge, but instead it stops at the end of the merge lane (which is not proper merging). The second car rear ends the first car, so second car's fault because the first car didn't know how to merge properly when traffic was light and there was a chance to do so.
Say suppose there's an accident on the other side of the interstate (going the other direction). People are wondering what's going on over there, so they slow way down and look. This is referred to as rubbernecking. Cars behind rear end one another resulting in a pileup accident all because someone slowed down to look at an accident that was none of their business. But still no fault to the car that slowed down ahead. All of the fault goes to the cars behind.
Say suppose a driver is lost on a 2 lane road and he/she is looking for an address number on a mailbox. Oops, I missed my address. Instead of pulling off of the road and turning around, the driver slams on his/her breaks in the middle of the road with a car behind that rear ends it. Still the driver from behind is at fault. The stupid driver who slams on the breaks in the middle of the road is not to blame. Even if the second car is able to stop, that would frustrate any driver if someone stops in the road for that reason. If it was an animal crossing the road, that's different.
Say suppose there's a driver cruising in the left lane on the interstate and is not passing cars in the right lane. Cars behind start passing on the right. And some do so with limited space. A car passes on the right and tries to get back in the left lane ahead, but doesn't have enough room to do so and collides. Is it the left lane driver's fault? Nope, it's the car who passed on the right's fault for making an unsafe lane change. And this could happen even if the driver in the left lane is moving 2 mph faster than traffic in the right lane and is driving side by side to traffic. This is a cause of road rage and aggressive driving/passing. Nobody should stay in the left lane like this unless they're moving about 10 mph faster then the traffic they're passing in the right lane.
Say suppose there's a car driving in someone's blind spot, the side of their car or of a semi truck. They're driving there for 5 miles. The car or truck driver needs to make a lane change and since they haven't seen anybody pass them for a long time, they proceed with the lane change and collides with the driver in the blind spot. Would this driver be at fault? Nope, the driver who was making the lane change would. This is a simple accident that could have been avoided if drivers don't stay in other drivers blind spots. This is especially true for semi trucks. But no car driver likes someone riding their blind spot either. Either speed up and pass or slow down and get back in the right lane.

I agree that stupid, careless drivers cause accidents all the time, and unfortunately, they often involve other drivers who end up taking the blame b/c they didn't anticipate the other driver's sudden move.
I think our laws should place more blame on the drivers whose careless or reckless driving is the CAUSE of an accident. However, this can be hard to prove without witnesses, since most careless drivers aren't going to own up to any wrongdoing.
I find it irritating when people insist that a rear end collision is always the fault of the driver in the rear. This is an easy assumption to make if you just assume that the person in the rear was tailgating. However, it's not always the case. In reference to your 4th example, I agree that if you miss your turn and you have someone behind you, it is not appropriate to slam on your brakes. You need to be aware of all vehicles around you. In a case like this, if the driver who ends up rear ending the other vehicle gets cited with tailgating, then the first driver should surely get cited for careless, inattentive driving. This one hits too close to home for me, as someone I love was involved in an accident similar to this. |

One should always assume/presume that every other driver on the road has no valid license and is an armed epileptic sociopath with psychopathic tendencies. And every time one sees another car on the road they should just start saying '''what if"' over and over in their mind.

Way too many examples. Yes, the stupid driver is at fault for the accident but will get off because it was the duty of the driver behind to avoid the incident. The only way to solve this is to "get paint" to the point where the stupid driver can't leave the scene. Now you can get his/er information and sue for incompetence, sue the driver examiner for approving the stupid driver, and sue the family of the stupid driver for not knowing s/he was stupid and keeping him/er off the road. |

1. In your examples involving merging, rubbernecking, mailbox, etc., the car in back should have been keeping far enough behind to be able to stop when the car in front did. If the car in back could not stop without hitting the car in front, then the car in back was following the car in front too closely (tailgating).
2. In your example involving passing on the right, the driver who passed on the right and then crashed should not have tried to get back into the left lane when there was not enough room. The driver who passed on the right should have stayed in the right lane until there was enough room to get back into the left lane.
In four of your six examples (over half), the driver "at fault" did do something "stupid". |

all you examples are ok but u fail to understand the rules of driving.
sure they are caused by stupid drivers. but the rules are this..
the driver hat is behind another car MUST leave enough distance to properly stop incase the car infront stops for ANY reason. if the drives of the rear cars did this they would not hit teh car in front.
lane changing. the one changing lanes is alway at fault if the others cars on the road are not doing anything. even if they are going slow. it is the duty of the lane changer to make sure it is safe to change lanes no matter the situation. even if a car is in ur blind spot all day long.
if the driver of slow car are in any lane it is there right. the speed limit is not a suggestion. its a law. even if the car on the left is going exactly the speed limit. it is the aggressive drivers fault for driviing aggresivly.
sure i dont like it when a slow driver is blocking traffic in teh left lane. but i wont try a dangerous menurver just to pass them. |
