Does placing signs on your truck free u up from any legal action?

i see trucks big and small that place signs staing " they are not liable for windshield damage due to falling debis. how can this be inforced? i'm talking trucks hauling gravel and it's not tarped! so if i put a sign on my car saying not liable for anything would it work?...ya right

Mostly this depends on where you live. The laws tend to be somewhat different from place to place. In most states this is restricted to commertial vehicles. Basicly this falls back to following distance. The drivers manual( at least all of the dozen or so that I have seen) all read the same. Usualy the six second rule. But if you read a little passed this you will see that you also need to be far enough back to avoid any possible hazards in, on, or with a possibility of becoming a road hazard. As the driver of any vehicle commertial or private, it is your resposibility to avoid road hazards. Just remember: Anyone can sue anyone for anything. The sighns are just there as a warning to stay away. Most of these go to small claims court and the large majority of them are dismissed because of this. I have hauled this type of material and have never even had to give a deposition or even speak to a police officer about this problem. As long as my equipment is in good working order the liability falls to the person following behind the load. Just a little FYI: I personaly witnessed a lady in a car who had her windshield broken by rocks from a truck, who called police and followed my partners truck to the truck yard, get a ticket for tailgateing.

I believe they are correct. It is impossible to prove that a rock from their truck cracked your windshield. People could defraud them all day long if courts let anyone with a cracked w/s say a rock came off that truck.

Best bet don't follow to close and make sure your insurance covers w/s's w/o premium increase

i think you misread it "flying debris"... people try every day to blame their broken windshield on every truck they see...
the signs are to inform people that are dumb enough to get too close ..they should back off ...they are not going to get there junk fixed for free...

No, they are liable for any damage they cause. It would be
difficult to prove they were at fault. Dump truck operators put
those notices on their trucks to entice drivers to back off in
hopes of preventing damage and a court case. Every state
has laws requiring drivers to secure their load (tarps, etc.)

If you are truly worried about a rock falling from the back of a truck and damaging your windshield, I suggest you mount a digital video camera to your dash and record the visual field in the direct front of your vehicle. If you can produce a video of a rock actually falling from the truck, you have a case... if not, too bad, you're S.O.L. !!!

Here's how it REALLY is....IF a rock falls from the truck and hits the road FIRST...and then your windshield the truck is not liable. ONLY if it hits your windshield BEFORE it hits the road is the truck liable. This has a legal precedent. Once it hits the road the rock then becomes highway debris and would then be the same as if a truck kicked a rock up from the roadway surface.

The ONLY thing that can FALL OFF TRUCKS IS WATER AND FEATHERS FROM LIVE BIRDS- any thing else is the truckers responsibility, sign or no sign PERIOD
