Wearing heels would not affect the height of your body from bum to neck area. So, as the whole thing is generally about where on your upper body the belt sits shoes should not be included in overall height.

Use your common sense! If your child is falling under the guidelines by even 1cm then you should get them a car seat. Why risk your child's life or run the risk of getting a fine for not complying with the rules?

Shoes do not count!! Im a police officer and just three days ago a lady here in San Diego asked me the same question after I pulled her over for it. It's something that people actually wonder and there is nothing wrong with it people honestly believe shoes count. The reality is that a child's BODY MASS has to meet the requirements for your states law, if the child does not meet those requirements then the child has to be in a car seat. If your at the border line it would probably be safer to keep the child in a car seat until the child exceeds the limit, hope to have helped you-alex
