Does this count as a hit and run and what should I have done?

This happened about a year ago, but I was walking down the sidewalk and saw a car about to pull out from the entrance to the gas station. I looked at the driver to make eye contact so that she could see I was walking in front of her. I thought she saw that I was there, but apparently not.

She started to shoot out into the street (there was an opening in traffic) and she hit me. I flipped off the side of her car, but I wasn't hurt. I was a little surprised and facing the opposite direction, so I wasn't able to get her license number.

There was no way she didn't realize that she had hit me. I pretty much flew past the windshield. She put on the gas and sped out of there as quickly as possible. Was this and hit and run since I wasn't hurt? and what should have done?

Yes it was a sidewalk that intersected with driveway (the entrance to the gas station).

I didn't think I could do anything since she was gone before I could get the license # or a good description of the car.

i had this happen to me..i was banged up..
i didn't report it..i had no plate# or anything.
and did not want to go to the hospital..
so in my case i hitched a ride home with a person who had seen what had happened

If you were on the sidewalk or a sidewalk and intersects a driveway, the pedestrian always has the right of way.

Yes. a hit and run is a hit and run no matter if no one got hurt or not. Probably little you can do at this point being as though it was a yaer ago.

You should have still reproted it to the police, her description (you made eye contact), car description, and where it happened.

Still try to at least report it to the police department, but they will wonder why you waited so long.

That was hit and run. The police should have been called and the accident reported. Also, you should have gotten any witnesses info. The gas station may have had cameras and they would have had the license plate number. What if you were hurt? She would have also been guilty of failing to stop and render aid.

Too late now, but you never know. You could call the police and still report it. The gas station may still have the tape and they could still find her.

Now you know the right way to handle it.

There is no question but that is was a "hit and run." There was no way the driver could know that you were not hurt. The driver is also responsible to look where the car was going, so, even if she did not see you before striking you, she would still be held responsible.

What you SHOULD have done, if possible, was to get witnesses to the incident. Even if you didn't get the license number, perhaps someone else might have. The other thing to have done would be to, of course, call the police. Again, even if YOU weren't hurt, what would deter that driver from running away from any other, similar incident? The police might have been able to find you witnesses AND, have gotten access to credit card numbers for the gasoline purchase.

yea i would say that is a hit and run cause she didn't stop to make sure u where ok.

i know here in south carolina u could get her for a big fine with that cause people have the right of way.

Pedestrians always have the right of way over cars. Certainly, the driver should have stopped to see if there was any harm done. Often injuries don't show up right away. You have two years to file for personal injury.

absolutely. she has no way of knowing if you had sustained any type of injury at the time without talking to you. it is illegal to leave the site of any accident without exchanging info.

this is definitely a hit and run you should have contacted the police straight away if this woman could see you were unhurt and panicked she could easily kill someone next time.

Yes - hit and run and yes you should have reported it to the police. It's a little late really I would think to do anything now.

If you saw the person about to pull out then why did you walk in front of her. Pedestrians may have the right of way, but doesn't mean that it should be excercised. People walking should be on the lookout when crossing intersections and driveways to businesses. I see too many people crossing the street in busy intersections and they don't even have a walk sign.

It is a hit and run. But since there was no damage or injuries, ultimately Im not sure if anything more than a ticket for, leaving the scene of an accident would have been imposed on the driver. Since you couldn't get their info, there's really nothing else you could have done. This is just another reason that women drivers should have to run flashing strobes on their cars. You know, like on the back of school buses. And everybody else will know to leave a wide berth to that vehicle. It still won't stop women from crashing into everything, but it may save a few lives.
