Driveway blocking an entrance laws and procedures ?

A guy in my street has a driveway with a dropped curb, last night I parked my car and it WAS NOT blocking entrance to his drive way at all..but he decided he wanted to park his car outside his driveway…not ON the driveway but he could fit his car in the space…so he pushed my car forward with his car he left me about an inch away from another car blocking me in I politely asked him to move his car and he refused. What would be my rights for this as I was not parked infront of his driveway blocking his entrance.?

Amy driveway or not if that space is assigned to him you are the one who is wrong, if it is not assigned to him specifically, then you have a case, but beyond that, he had no right to "push " your car, I would call the cops...this could get worse, nip it in the bud, good luck...aren't neighbors great?

First of all...he pushed your car "with his car".
Any damage to your car?
Did he then notify you right after moving your car by pushing it? Could be considered a hit and run if you can show proof.
btw...you could have damage to your car you're not aware of yet...
when we park our cars it's usually with the Emergency Brake applied along with it being put in "Park" or left in gear if a manual transmission. You push that car, something's going to break.

Second...if this dispute escalates further and becomes worse than it already is, your word against his, TAKE PICTURES of the area you're talking about that supports what you're saying...you'll be glad you did when you both end up before a judge.

Most City Ordinances do not allow blocking driveways which is the only thing you could have been faulted for if you did.
Also, parking on a street is never assigned parking and anyone can park wherever they want.

Be careful, this guy is possessive about who parks in front of his place and he has a chip on his shoulder. If there ever is a confrontation, have a video camera handy for your wife or someone to record if/when he physically attacks you over this.

You have every right, the road outside someones house is council property not theres. As for him to touch your property (your car) you can kick up a big fuss about that. He cant do such a thing as move your car! If you are not blocking his driveway and the space outside his house is not reserved then he can be done for moving your property without consent. There is a proper name for moving someones car in this manner (my dads a copper) but for the life of me it has escaped me

First of all, no-one has any right to on-street parking unless a specific space has been allocated, which I very much doubt. He has no right to park outside his house, nor do you for that matter.
Technically, yellow lines or not, parking on the highway is only permitted in specific designated parking places.

Did he damage your car, and have you any witnesses? If so, report him to the police for criminal damage - if you want the aggro.

you should not park any where were the kerb has been lowered. saying that this guy should not have moved your car the way he did. speak to the police and see what they say because at the end of the day he hit your car and did not report it.

Provided that space has not been specifically reserved for his use, you are within your rights to park there, as you were not causing an obstruction.

Did you see him push your car? I'd report it to the police immediately. Don't leave it to fester, these things can escalate. Nip it in the bud.

Also, do not be tempted to get revenge by damaging his car. You could end up in trouble then. Make sure you're in the right, take the moral high ground.

Interesting question, looks like you have some researching to do on the laws for your area.

One thing does come to mind for me, probably because I own a towing company and am up on those laws, at least for Oklahoma. Any vehicle that moves another vehicle not under its own power must be licensed and approved as a tow truck, unless you are moving your own vehicle. Since he moved your car, at least here I could have him ticketed for illegal towing.

I think in your situation I would have called the police, explained the situation, and let them sort it out since he was depriving you of the use of your vehicle.

Unless there is some kind of local council parking permit in operation, no one has a 'right' to park anywhere including outside their own house.
If your car was parked there without blocking his drive then tough luck he has to find somewhere else to park. If you where not parking there to wind him up, check your car for damage, I can't see how he could 'push' your car with his without at least knocking your bumpers out of alignment or damaging them. If there is damage, go to the police station and report him for malicious damage to your car, they have to investigate.

I'm assuming here that you parked across the lowered part of the pavement. You are legally not allowed to park here as it could be construed as an obstruction, whether you think you were obstructing or not. He shouldn't of pushed your car out the way, however why didn't you park far enough forward into the space he moved you into in the first place? Why didnt you park YOUR car outside YOUR house?

If the police had been called and you were parked in any way over the lowered part of the pavement which is there for access to this persons driveway. Then its likely you would of been made to move or booked for obstruction.

Look at it from his point of view, he likely parks over HIS driveway entrance every night, how would you feel if he parked over yours blocking your drive off?

This guy is a bully. He Will not care what you think or say. He Will do the same again unless you take steps to stop him. I'd suggest rigging cameras to film his activities - he will do something again to you - so you will need to be prepared to gather evidence against him. I'm not sure how interested the police will be in this - they will probably shrug it off as a civil matter unless any real damage is done. With evidence though you could take civil action against him. Good luck and take care.

You could legally press charges against this man as you didnt park over his driveway and he felt the need to make it an issue
just becasue you parked near his driveway.
Or you could just get a really big bat and smash the wa*kers windows. I would :D

Sounds like you made an a-hole move by blocking his driveway (partially or not) and justice was served. For him to take it this far, I'm guessing it's not the first time it has happened either, is it? Whether or not his actions were legal, your actions incited this situation. Do a little self reflection and ask yourself who really caused this? I think you got what you deserved, regardless of how our namby-pamby enforcement branch sees it.
