Driving Over The Speed Limit?
|
My friend and i are a having a dispute. He thinks it is perfectly o.k. to go 70-80mph in a 55 zone. I think that he is completely nuts, and that no matter what the flow of traffic is going, he should always obey the law. He thinks that it is safer to speed if the flow of traffic is doing so.
Who is correct?

You can get a ticket for doing one mile over the speed limit. You don't see it happen but it would be totally legal. The safe law can be applied to the statement "no speed over the posted speed limit would be considered safe." So your friend is completely wrong. It doesnt' matter, he's going to find out soon enough with this attitude. |

Going 15 MPH or more over the posted speed limit is not safe, regardless of the other traffic around you. At those speeds you can forget about a speeding ticket & are now considered a reckless driver and can be pulled over and issued a 4-6 point ticket for reckless driving or reckless endangerment. These offenses also carry a very high fine along with the high points. And you can be singled out of a pack of cars that are all running 15+ over and the citation will be valid & you will suffer the consequences.
There is no grace period either. You do not legally have a 5 MPH window & if the officer wanted to be a total prikc he can legally pull you over and cite you for doing 56 in a 55.
And I have yet to see any US officer pull someone over & cite them for obeying the law. I have been to Atlanta hundreds of times, have spoken to a few Atlanta & Georgia State Police officers & I have not heard any of them ever say anything about where Atlanta cites people for doing the legal speed limit & all of the other cars are exceeding it.
To the poster that is claiming that, I would love to see hard concrete proof that the citation was under those conditions. Because frankly, I place your statement into the same category that you can no longer get your license at 16 if you were born after 1994- the BS category. |

It may be safe, but the cops might have something to say about it. |

You are correct. There's no point in going over the limit by that much. You're only allowed to be over the limit by 5 MPH. Going that fast could lead to accidents and such but that's his choice for his life. |

I think it's safer to go within 5-10 mph of the flow of traffic. So, if traffic is moving about 80 in a 55, I would drive about 70-75. Driving 55 mph with traffic flying by you at 70-80 mph is very unsafe. It increases your chances of being hit from behind at a high speed and can cause you to lose control of your car. And it will likely be fatal for you and other drivers. The minimum speed I would drive would be 65 mph in those conditions. That will give drivers coming up from behind time to slow down, adjust their speed, or change lanes to pass you. Also always stay out of the far left lane (on multiple lane interstates) regardless of how fast you're going unless you're passing other cars. |

George A - Thank you.
You're correct.
Speed limits are posted for a reason and should be obeyed. Go 70-80 in a 55 zone? He's asking for either an accident (and he's lucky if he, or whoever he hits, survives) or a ticket.
Safer to speed if the flow of traffic is doing so? Speeding's never safe. Not to brag, but I set my cruise control at the posted speed-and see others zoom past me only to end up behind another car and hit their brakes, a truck pulls out in front of them, or they're pulled over by an unmarked-or two.
All of that speed for what? |

It is safer to flow with traffic. Going faster, slower or anything else that disrupts the flow is going to increase risk. Just because the speed limit is 55 and you're going 55 it's not going to create any safety. There is more risk when not going with the flow of any situation, not just driving. |

Yeah, this is one topic that is always on my mind, being a speed limit driver. I think it's OK to go 5 miles over the posted limit but not 20 or 30! That is complete disregard for the safety of others. I often have my elderly Mother and/or my precious dogs in the car with me and I try to be very careful. I agree that your friend is nuts |

In many states, you can (and I have seen it happen) for going the speed limit when other traffic is exceeding the limit. You should always keep up with the flow of traffic...regardless of what the speed limit actually is. Obeying the limit in this case creates a danger to others and you will get a ticket for impeding the flow of traffic. It is actually more dangerous than speeding...especially if you are one of those people who likes to hog the left lane and go exactly the speed limit. Speed doesn't kill...reckless use of it does. |

Slow drivers on busy streets are a BIG cause of rear ender accidents. If traffic is going fast, you need to keep up so you don't start a pile up behind you. There is no need to go 30 in a 40 because traffic is heavy. Honestly, 55 mph roads are safe to speed on if they're mostly straight and you know how to handle a car. I can drive 75 safely on a 55 mph road, and if there are cars ahead of me, I will slow down.
I think speeding gets a bad rep from young kids not being able to stay in their own lane and crossing over the center, or not knowing how fast is too fast for a corner and driving off. Also, speeding in rain, snow, ice, and fog- Don't do it. It takes a close call to realize how dangerous it actually is. I didn't slow down in bad weather until I nearly wrecked my car....but again, on a dry road you know well, speeding is fine if you can handle it. |
