Failing to use turn signal/collision?

If someone fails to use their turn signal and someone rear ends them because of it.. is it the person who rear ends thems fault in EVERY CASE.

there will be 2 tickets issued for this accident, 1. failure to signal turn or lane change, 2. following to closely. so both drivers are at fault. and no it is not always the fault of the following driver in an rear end accident, but it mostly is

You are correct. The person in that rear ended the other driver would receive a citation in texas for "Failure to Control Speed". It other states the name of the citation could be different but it would mean the same thing. They didn't stop before they hit you.

However, accident aside, this doesn't mean that the police officer on the scene couldn't write you a ticket as well for not using a blinker, thus causing the insurance companies to argue a little longer before finding the other driver to blame.

It would always be the person that rear-ended the other cars fault......never assume while driving and always expect the unexpected.

CANT YOU SEE THE DARN BRAKE LIGHTS!!! IDIOTS I mean i hate when someone doesnt give a signal but you still should see the damn red lights staring you down if you hit someone cause they didnt throw a signal you deserve to be at fault because your a moron
