its not at all ridiculous ..its the duty of a driver to be aware of what is going on around them puddles don't just appear out of nowhere so the excuse " And if I'd swerved to avoid the puddle I might have caused an accident " is just a cop out. She should have seen the puddle and moved to avoid well before having to swerve out of its way .. suppose the guy was standing there with a kid ..and rather than the puddle it was the kid who stepped out into the gutter. People have just become bad drivers to caught up in themselves and not worried enough about other road users.

I AGREE WITH THE DECISION. Splashing people with a puddle is illegal. Throwing litter out the window is illegal. Spitting at someone through the window is illegal. Blowing the horn and waving at people is illegal. Were do you draw the line? She should of slowed down until there was no traffic on the other side of the road and then drove around it. SIMPLE FOR ANYONE WHO KNOWS HOW TO DRIVE AND ALSO HAS STUDIED THE MANUAL. |

Being splashed by a puddle is NOT funny, especially if you on your way to work.
It happened to me yesterday. If I had gone home and changed I would have missed the ONLY bus that goes from the village were I live to the nearest town, and would have lost a whole days pay - which I can NOT afford.
If anybody had bothered to read there Highway Code, you would have seen it is a Criminal Offence to splash a pedestrian. |

It's a real bummer. Wrong puddle at the wrong time.
But you should have slowed down enough so you didn't splash the person. Not doing so,deliberately shows a lack or consideration for pedestrians. Doing so accidentally, shows a lack of control of your vehicle or lack of awareness of the road surface.
Puddles often conceal pot holes, open drains, foreign objects...any of these can cause your car to swerve if you are driving at speed.
If there was room you should have steadily moved out to avoid the puddle, if not you should have slowed down and driven carefully through it like I said.
If it was a really big deep puddle you should also have tested the brakes gently afterward as they would have gotten wet.
You should have noticed the puddle in time to take either one of these actions - this is why your instructor will go on about looking ahead, planning your next move.
You will pass, just keep trying! Remember they have a huge responsibility to the public on whether or not to pass you, and they can only judge you on how you drive in those 40 minutes. |

She broke the rules. she failed . Simple as.
IF she had been paying attention to the road then she would not have been driving faster than the conditions allow and she would have been able to negotiate the hazard in the correct and safe manner.
Suppose there had been a bus at the bus stop. Would she have ploughed into it and expected a pass? I think not.
A hazard is a hazard . It does not have to be ten feet high and bright red .
Funny how it is always the examiner's fault in the event of a fail |

If you commit an offence on your driving test, you will fail.

Yes, it is unfair. Because i was soaked as were my daughters by a fuel tanker on the Leeds Ring Road and when i went to Pudsey police station to report the offence, the pigs told me to go away as it 'was trivial'.

You hear of ridiculous reasons like this all the time.
There is a rumour that has circulated for a while now, that every examiner HAS to fail a percentage of the people he tests, regardless of how they drive, in order to keep the number of road users down.
Incidents like this just add strength to the theory. |
