Following too closely ticket?

I was recently involved in an accident where the car two cars in front of me stopped to let a pedestrian cross, so the truck in front of me braked hard and made me slam on my brakes and I hit the back of his vehicle. We pulled over to exchange information and a cop saw us and pulled over. Since there was no damage to the other car he isn't filing a claim, and just went on his way. I on the other hand received a following too closely ticket. I was just wondering if there is any way to fight it, and is it worth it to try and fight it? And if i just plead guilty how much will it be?

There is nothing you can do in this situation. You were following too closely and the officer was right to give you a ticket. The thing you must understand is that if you hit a person in the back no matter what is happening in front of you, you are automatically at fault. The person that hits the back of another driver's car is always at fault. So yes, it would be a waste of time to fight this ticket. It is just a law that was put in place which states, that if you hit someone else from behind then you are at fault, and your insurance rates will increase as a result. As far as the pending charges, well it depends on the state rules. Some states charge more than others. There is no set penalty as far as how much you have to pay except with your state. Whatever the penalty is you will have to pay. Don't try to fight this ticket because it will be a waste of time since you were at fault.

The following distance should always be the 2 second rule that we all learned in driver's training. This is for safety. As far as the ticket, pay it, you earned it. Although, if the cop doesn't show up to court, then you may have a chance to fight it.

If you hit the back end of another vehicle, you were following too closely. You didn't leave enough room to safely stop. How are you going to fight that?

Depending on what state your violation was in, you will receive points on you license. I know in Pennsylvania, if found guilty, you will receive 3 points on your license. The vehicle code is 3310 (following to closely). This ticket is a judgement call by the officer. There is good chance you can this argument. Where was the officer located at the time of the accident? Did he himself see the accident or just passing by? Was there an obstruction of view? etc...

Unfortunately, the evidence is against you. I'm guessing that what you said here is what you told the police. About the only way out is to ask the court if there is some way that points will not be assessed against you. If your record is clean, the court MAY let you take a defensive driving course or similar such thing plus a fine. For the monetary penalty, plan on $150.

I'll agree with most answers.

Not blaming you, enough have done so already, but technically you're supposed to be "in complete control of your vehicle at all times." That includes creating a cushion of space between you, the car in front and cars in other lanes, depending on the road.

Sometimes that cushion doesn't exist if there's a gang of cars around me. That's when I slow up and watch everyone zoom past me in a group.

they are so hard to beat especially if there is any damage to either cars the judge sees it as a safety violation and most state laws make you automatically guilty if you rear end somebody for any reason. for example the guy in front of you stalls they expect you to keep enough distance to notice and stop in time, i wish you the best though!!!
