Have you ever been charged with careless driving?
|
I was accused with careless driving and was charged for this offence,,,but the funny part is ...the police got the information by someone reporting me..which was a surprise to me..there was no damage ( a question I asked the police...he said no) I asked if anyone got hurt..he said no ..but apparently I tried to run him off the road.( it was a motorcycle) now I have to go to court...pay a fine ...lose points...increase in Insurance...has anyone had a simular experience?

As Real As It Gets

If you had been a more attentive and careful driver, you wouldn't be going through this.
And maybe the fine, points, and insurance increases will be enough of a jolt to make you more careful in the future before you actually DO hurt or kill somebody. |

what was the funny part again?
i'm so sorry for that guy you ran off the road and DIDN'T EVEN KNOW you did it.
he could've been dead in a ditch and you would have been oblivious.
to answer your question...no i haven't. i pay attention when i drive instead of putting on my makeup |

Never. And I would fight the charges if you really believe you are innocent... |

Haven't had the same thing happen, but basically when you show up for court, if the "witness" who called you in doesn't show, you'll probably get off the hook since there will be no one to tell an opposing story.
Cross your fingers!! |

yes
do yourself a favor. get a lawyer, have him/her go to court for you - they'll get the charges either dismissed or reduced to something that doesn't even matter. That way you won't have increased insurance payments or license points |

Yes, it can happen if the person you almost hit actually wants to press charges against you. Any motorcyclist worth their leathers is ALWAYS on the lookout for idiots in "cages" that aren't paying any attention, because no matter whose fault it is the motorcyclist loses.
Ask yourself a few questions:
Do you talk on the phone while driving?
Do you drive a large vehicle with large blind spots?
Are you SURE your mirrors are adjusted correctly, and do you use them EVERY TIME?
Do you ever NOT use your signals?
Do you listen to loud music while driving?
If you answered ANYTHING other than "no" to any of the above, then chances are good that you DID almost run a motorcyclist off the road without knowing it.
In which case, you will have to appear in court and defend yourself against the rider and his accusations. Whether or not you did it, be careful and pay attention to motorcycles out there. |

my bf recently lost his dirver license because he's license was cancelled without him knowing. so he got a fine for reckless driving and driving unlicensed. he also has to go to court, even thought he can't drive anymore and paid over a thousand dollars of fee. so that's why i don't drive at all! |

Not really, just speeding tickets. I got arrested once for doing a burnout out of the school parking lot, then speeding in a school zone in my un-registered, un-inspected car with a suspended license; I guess that could be considered careless driving! |

No, but I'm so glad to hear that careless drivers CAN indeed be ticketed.
Lucky for you no one got hurt, or else you'd have the hospital bills to pay, on top of everything. Maybe you should keep your anger in check next time, and remember that you're in control of a lethal weapon when you're behind the wheel. |

No.
Why would you think there would have to be injury or damage to make a careless driving case? Obviously there is a credible witness that reported you doing something careless that is willing to testify in court as to what you did.
Of course if you actually didn't do it, they have the burden of proof, and if you aren't found guilty in court you won't have a fine, or points. |

If the cop did not witness it than it is your word against another civilian, so the case should be dropped. Take it to court. If you testify that you were faultless and did not do anything to cause anything to anybody then you should be alright, if you say you did run someone off the road, well then just don't waste your time and pay the fine because you will be testifying against yourself. Of course if you go to court you are suppose to tell the truth, since you were there you should know what that is. |
