Hi everyone, please help? i know its awful but i was caught driving drunk few days ago, i refused to give a breath or blood specimen. The court date is soon and i am paniking. I have read related websites and i know that i am facing driving ban, a fine and a possible imprisonment. Well, imprisonment sounds well scary, obviously dont wana lose my license as this will implicate my financial troubles:(( what can i do to smooth things a bit before the court? whats are my chances? is the imprisonment really that possible?
sorry guys, i know what you may feel, i am open to any comments and judgements, but i am hoping that perhaps some one could help with advise or maybe good solicitor number or just a few words of assurance? cant sleep, cant eat, have made myself a promise of the life not to do this ever again. Waiting for your answers

That could've been me driving next to you...grow up and be responsible for yourself. I don't drink which means I am certainly not on the road drunk, I would expect the same courtesy from you and everyone else. |

Quite frankly I hope you go to jail.
What if you had killed somebody?
But anyway you are likely to get a fine and loss of your driving privileges maybe community service, IF this is your first offense I doubt they put you jail this time even tho they should. |

They are also likely to know what the judge who is handling your case is likely to do if you plead guilty, or if you are convicted after a trial.

I'm not going to lecture you on your stupidity...you already know you screwed up.
You need to realize that you may face some serious consequences. Refusing to provide a blood specimen or refusing a breathalyzer is more or less admitting guilt. If you have nothing to hide, then why not just do it? If you refuse, then the officer can only assume that you DO have something to hide and arrest you for DUI. Since you refused the test, you can't prove that you were NOT drunk so you have no leg to stand on there.
That is one major factor that will cause some problems.
The penalties you may face depend on many factors. One is the state you live in. Another is your prior record (if you have one). I don't know if refusing an alcohol test is grounds for felony DUI. It might be. As it stands right now, you will likely face fines, loss of your license (suspension or revocation but a suspension is more likely), higher insurance rates (they will skyrocket), probation and possibly jail time. You will also lose points off your license.
If losing your license would be a severe financial hardship, you can apply for a restricted license, which would enable you to drive to and from work, to and from school or to and from medical care ONLY. You drive at any other time and get caught, you will almost certainly lose all driving privileges and possibly face futher penalties.
Contact a lawyer. You might say that you can't afford one. Well, believe me, it will be in your best interest to have one. Also, asking the judge if you can attend a DUI school might help. Just another point though...if the judge approves and you miss a class, you've screwed the pooch.
I hope that next time you will think twice. Is drunk driving really worth all this? Also, consider yourself lucky that you didn't hit and injure or kill someone. You would be looking at far worse than DUI...like vehicular homicide.

All across the country, states are cracking down on drunk drivers. Don't expect the judge to listen to a sob story. It won't work. You messed up. Accept it and deal with it. I hope you never make a mistake like that again. |

Depending on how smooth your record is, you may get by with a fine and a suspended license. If you have had trouble (tickets, collisions) before, don't expect any mercy. And you refused to cooperate with the police who wanted to verify your condition. Not a good thing. You need the counsel of a solicitor (attorney), which along with any fines and costs of the court, you're looking at least $1500 expenses. If you can convince the judge of your repentance, that might ease things a little - MAYBE!
And until you get this done, you cannot renew your license, re-register your vehicle or rent another vehicle. You might want to see about getting a state ID card just to prove who your are and to get you through the airport.

Whether you do it or higher a lawyer, but approach the prosecutor for a deal in that you plead guilty to impaired and they drop the refuse breathalyzer as well, no jail time.
You are definitely looking at losing your license. |

Well...I'm not going to compound what's already been posted before me....so...I will just say...
You f****d up!!!.....take whatever punishment is coming...and....do what they tell you that you have to do.
You did commit this offense...you will live with the repercussions...and.. learn from this experience....commit to your word of..."never doing this again"...and when it's over...live your life knowing how lucky you were to not have injured or killed someone.
I hope you never do have this experience again...because...now that you have this DUI on your record....a repeat offense is going to be even tougher on you next time.
Good luck with this....and you can redeem yourself when it's all said and done....it's just going to take a while to get there. |

Aww. Poor baby! I know this has taught you a big lesson, Now you can tell others your expierience and really teach them the dangers of driving drunk behind the wheel. And if you get a chance to testify for your self in court this is one of the things that you should mention. Yes, theres a big chance of going to jail, but hopefully If your record was clean before that most likely they'll charge you with a heavy fine. The good thing out of this though is that you didnt hurt yourself and most importantly hurt somebody else. Also getting a lawyer to help you out and clear your case Is something you should be looking forward to im guessing if the matter becomes serious. As of right now, You better start praying because thats all you can do..
