How does your car insurance verify this?

when you get into an accident and the police dont come, how does the insurance tell who was at fault? how do they know who was telling the truth and who was lying without a report from the police

They don't know. This is why it is vital to get names, addresses from witnesses ASAP at the scene of the accident. They are more willing to volunteer then. Later they will think it over and decline. Most potential witnesses don't volunteer because they are afraid they will be called to court to testify and will lose time from work and expense and inconvenience of being there. However, it is so important to get witnesses that, if you have them, and they are favorable to you, the other party will usually settle out of court. The witnesses will never be called. This has happened to me.

If you can't get names and addresses, get car makes and tag numbers of drivers who may have seen the accident.

It is the latest thing that police will not come to fender benders, only to personal injury cases.

Above all, if you are at fault in an accident NEVER admit fault . Simply give your info, get theirs and say your insurance company. will be in touch. If you check your policy you will discover that admitting fault at the scene is grounds for cancellation. Also NEVER NEVER offer to pay out of pocket for damage so as to not report to the insurance company. The idea is to keep your premium from going up. This is positively grounds for cancellation and you will have problems ever being insured again. This is a legal admission of guilt and the only question now is how much. A dishonest person can claim all sorts of serious injury to themselves and people in his car that you never saw and damage to their vehicle that never happened. You can be ruined. Don't believe me ? Ask an insurance adjustor.

A lot of states have gone to a no fault policy in the event of accidents. In a no fault state the police will not do an accident report unless there are injuries or at least one vehicle needs towed.

In those states if the vehicle owner has collision insurance, their insurance pays to fix their vehicle and then the insurance companies battle it out in arbitration. Arbitration is kind of like court without going to court.

Did you call the police at the time of the accident and they didn't show up? Or were the police not notified at all?

You should always have a police report written up whenever there is an accident for this very reason. Some insurance companies however will fight with the other persons insurance to get money for your damages.

Not completely sure.
you could take like 100 photos of YOUR vehicle, the other person's vehicle, where they are hit, the road, so they'll know if there were any skidmarks. All around. Sometimes investigators can maybe try reconstructing the scene.
Call the police first though, that'd be the first thing to do. And be SURE to get the license plate of the other vehicle, they may take off just before the police get there.

Damage, description of scene, position and direction of travel will disclose who was at fault.
