If you are being summonsed under Section 2 of the Road Traffic Act, you are not eligible for a "fine" option. This means you may have to attend Court where a judgement will be reached. If the CPS have a cast iron case they will prosecute under the current policies but may also invoke an order to attend a Driver Improvement Course, run by your Local Authority.
Take this as a positive step, you will learn something. |

in a word no if you are driving without consideration you are not concentrating if you are not concentrating you then become a danger not only to yourself but all other road users do you want to have the death of another person on your concious because you are driving without consideration i guess not so pay up take it on the chin and drive more considerately in future hope this helps |

ANY motoring offence can be dealt with by summons to court, it just happens that with some offences you MAY be offered a fixed penalty option - it's not compulsory. |

The full wording is "driving without due care and attention to other road users" I think you will find that fixed penalty does not apply to this offence |

If you drive without consideration for other people and vehicles on the road then you must be driving dangerously in which case you should have a prison sentence not a fine. |

Nope if the offence merits it, no offer of a fixed penalty is made, the offence is considered too serious and a court must deal with it. Only minor offences are offered the fixed penalty with the option of refusing it and having your day in court - seldom the cheapest option unless you have a rock solid defence or have to avoid toting up 12 points and plead to retain your license on whatever grounds your laywer thinks will work. |
