I got a ticket with a radar gun that I think wasn't working.?

I got a speeding ticket. The officer was hiding behind a chain link fence and using a radar gun. It was a very windy day. Can the radar be compromised due to the beam bouncing off the fence? And, when we saw the radar gun the display was not working properly -- the number display was missing some sides to the numbers. For example, the number 5 on the display screen was missing the top line. I figured since the display was not working, what else is wrong with the gun. Any help?

How fast is too fast.....

HECK, get an attorney no matter what. If the speed is low, and you are a good driver, they may drop the charge to unsafe equipment.

If not, you will need to fight it because of what will happen to your insurance premiums.

I'm sure the attorney will ask.....
"Officer, when was this gun last calibrated?"
"Officer, have you been trained in the proper use of the gun, and were yous using it according to that training and following all of the procedures of the department with regards to the radar gun?" (hint, this answer is always yes.)
"Officer, when did you notice the display on your radar gun was not working properly?"
"Officer, when did you fill out the request for repair of your radar gun?"
"What is the procedure for when to fill this out?"
"Does your procedure on gun operation indicate you should keep using the gun when the display is faulty, or to take the unit out of service and write it up for repairs?"
"Officer, I thought you said you always followed ALL of the procedures, so why did you not follow procedure and continue to use a gun that might be defective?"

See where this is going?

if the radar bounced off the fence, then it would've said you weren't moving rather than saying you were speeding.. because the fence wasn't moving..

as for some of the number bars not working, thats no biggie, and the judge won't dismiss your ticket for that...

take it to court if you want, but you'll more than likely end up having to pay the fine (and the judge can even increase it if they decide to)...

just own up to speeding and pay your fine...

Answer is simple, pay the fine and take traffic school. It isn't worth fighting. You will waste more time and money trying to fight it, than it is worth.

If you take it to court, you will most likely have the fine INCREASED instead of dropped. Police radar has no problem with chain link fences. And wind has no effect, either. There is no law that says the speed display must have 100% of it's LED's working, either. If you go into court with these lame excuses, you could leave court with a bigger fine than you went in with.

Most all states require the police to have their radar guns calibrated at least twice a year and you could challenge this by asking to see when this radar gun was last calibrated...

Fight the ticket,in traffic court the officer will have to tell you when the radar was last calibrated,or serviced.Bring the points you mentioned up in court.
