I had a car accident in the parking lot. My car was parked within a marked diagonal lines accordingly, and?

this woman (in her 50's) was too lazy to park it properly. She parked like a parallel on the right side of my car. When I backed my car and did not see her left rear bumper crossed my zone, my right rear bumped into her left rear metal bumper. My 06 Lexus' bumper totally messed up on the right. Her pickup was a 1985 Toyota, and it sustained a minor scratch on the metal bumper. I could not see her pickup's bumper had blocked my right bumper on the rear-view mirror, on the passenger's side. Her pickup was parked and unoccupied when I bumped. Had she parked her car properly in the marked diagonal lines like everyone, this accident wouldn't have happened. She verbally admitted her fault and was willing to pay for my damage. The insurance company of each side is investigating. Could you please tell me who is at fault in this accident? Dude. Who was driving the car? What if a dog or child had wandered into your parking space? Who would be responsible for backing into the obstruction then?

Sorry. It's not a legal opinion. That's just how I feel about it.

Hitting a parked car is always the driver's fault. Just my two cents.

Let me guess ... no tickets were issued, right? If you live in a comparative negligence state, the insurance companies will assign a degree of negligence to each of you and pay you that percentage of your damages. If you live in a pure negligence state, they will battle over who was at fault.

you were driving and she wasn't in her car, so you were for not checking around your vehicle. but in a parking lot (private I assume like a grocery store) unless the owner will press charges no one will get a ticket, but you insurance is fixing to go thru the roof.

Verbal admission of guilt is probably not quite enough... you will need to get that in writing and soon before she changes her mind.....

Word to the wise though, and this goes for everyone: It is ALWAYS a good idea to do a quick visual inspection of your car and parking space before leaving any parking lot. You may find broken glass, other debris under your tires, good idea to check for signs of leaking oil or other fluid... It only takes an extra 10 seconds to walk around the car and then leave... which would have prevented this damage in the first place.

As much as you are trying to get support, you may not be having much luck. the car was parked, it was not moving and you were. Parking lots are private property and most of the time the police will not file a report on it. It will most likely be determined no fault and both insurance companies will pay for each ones car. Your insurance will go up or at least if you have one free accident, you will have used it up.

You were both at fault, her for not parking properly and you for hitting her. Good luck and be more careful in the future.
