The problem is I gave a recorded statement to the person who struck the lawn mowers insurance company. The woman who was from the ins co tried to tell me that I waved the lawn mower man out in front of the oncoming car which is totally not true. The lady who hit him and her husband responded by saying it is no big deal if you waved him in front of the car. The lawn mower guys attorney tried to say I did the same. The lawn mower man told the police he just forgot to look which is what happened. I am worried that these parties are going to try to do this again at the deposition. I was just in my driveway and now it seems I am being pulled in. Any ideas would help. Of course bc I have not been named in the suit I have no attorney to get advice from. My insurance company won't help and I feel bullied by all these people. Any ideas would be helpful

Answer the questions truthfully and keep your answers short and on point. If you're asked a yes/no question, answer "yes" or "no." Do not answer "yes, but." If you don't understand a question, say so. Don't assume you know what the lawyer is asking. If a lawyer asks you a two-part question, be very careful. Say, "Could you please ask one question at a time?" Then wait for the lawyer to rephrase his question.
If you don't know an answer, say you don't know. Don't try to speculate or guess. Don't argue. |

I would just tell the truth as you've done here.
Try not to feel bullied, which is easier said than done.
The guy on the lawn mower told police he just forgot to look.
Generally, witnesses don't get lawyers and sometimes witnesses are not even called. Don't sweat it. |

get a lawyer I know it can be costly but you could loose more if they turn the tables on you or you could plead the 5th, I suggest get a lawyer to watch out for your best interest that is what there lawyers are doing. |

You must respond to the subpoena or you can be held in contempt of court. Just show up on time and make your statement and no matter how they try to turn things around simply keep repeating your basic statement. " I saw ____ " and "I did nothing which in any way caused or contributed to the accident" |

Do not deal with the authorities yourself.
You need to at least first talk with a lawyer because he or she will need to ensure that your cooperation will not be used against you at a later date. |
