I have, for the last two years, been toiling with a local bus company after one of their buses hit me ?
|
I was sitting at a side street junction, not even in gear when a bus hit me. now the day was a saturday afternoon in a busy town centre and the traffic was backed right up. the only thing was that the inside lane was a bus lane and the bus came hurtling round, around 30-40 mph and hit the front of my car shunting me back. the bus did not stop and i had to get out of my car and run down the street where luckily the traffic of the merging two lanes had stopped him. now the bus driver said that he thought he had hit something in the road but didn't think it was bad enough to stop.as i got to the bus i girl had demanded to get off claiming the driver was not fit to drive that bus and was too dangerous.
now the bus company are claiming that i had pulled out on them and that the girl was not able to see the accident (she was sat in the very front seats with a pram. and after two years will still not accept liability.
Has anyone had similar problems to this before and found solution because it is very testing! >:-( Additional Details There seems to be confusion here. There where witnesses who have testfied, i mentioned the girl on the bus. also i have gone through the insurance route. i contacted them straight away. i have all the details of the bus driver and bus AND witness.
my question was has anyone had similar problems with bus companies doing this sort of thing before?

you need to put in in the hands of a solicitor, they will put time bounds on thier communication and resolve it ( one way or another ) |

Just an idea..........why don't you go to your local news or tv station and tell them this story and have your witness ready to go if needed.
I would think that the city would not like to see something like this on the air and I also bet that you would get a lot of support from the public. |

You are crying over spilled milk. You should have contacted the police immediately. Then your insurance company and a good lawyer. Hopefully you'll be more prepared in the future. |

Well, assuming that you did the correct thing and reported the matter to the police as failing to stop. Then contacted your insurance company and took details of the bus (Reg No etc).
Why have you waited two years?, or for that matter allowed this to go on for two years? |

Unless you have ironclad witnesses you have,nt a chance, the bus lanes are very fiercely protected by the judiciary ,for good reason. If your car was even overhanging the white line of the bus lane you are lucky you were,nt prosecuted.Disabled parking places are the same even if your bumper is over hanging the dividing line you will be towed away. This case will probably be settled knock for knock by the insurance companies. |

Get a solicitor.
Contact your local authority and see if there are any CCTV images available that may support your claims.

Ideally you need to find you own witnesses who were there at the time to confirm what was happening - did you have a passenger in the car etc... unfortunately if this fails it is purely going to be your word against the bus company - and this is no doubt what they are vouching on in the hope you back down.
It may be you can get a payment out of them without them accepting liability. My best advice would be to go see a solicitor or the CAB for further advice with someone who can go through all the details and docs you have - sometimes instructing a Barrister for their opinion is a good way to go.
Hope this helps |

You need a solicitor. Big companies will never accept liability. My car was hit when it was PARKED ON MY DRIVEWAY by a driver of a large well known company in a delivery truck. They of course denied it !! But just the mention of the solicitor sorted it... |

From what you say it comes down to your word against the bus driver and no witnesses.
