I was driving my 2005 acura mdx saturday night and had to swirve out of the way of a vehicle that had swirved
into my lane which caused me to crank the wheel right and my brakes locked up and i lost control onto a side street and slammed into a curb. about 7-10k of damage was done. why did my brakes lock up? could i possibly sue the manufacturer for the ABS not working properly?

Well, it is possible for brakes to lock up even if they are ABS. Anything man made will have some kind of issue at some time or another. I don't think you can sue the manufacturer because parts in cars do go bad. Suing the company of the brakes would get you nowhere. Instead of suing you should let your insurance cover the damages if the accident wasn't your fault. Brakes can be faulty over time, nothing in a car lasts forever. I would however look into getting a new braking system. Just be glad that you are ok, and the damage wasn't greater than it was.

Also learn from this, speed was likely a factor. If you were speeding you need to learn from this and slow down.

When you cranked the wheel over playing race car driver the car came out from under you and slide to the curb had nothing to do with ABS brakes sounds like you might have been going to fast.

Swirve? Is it possible you mean swerve?
I don't think your ABS locked up, I think you threw the car into an manoeuvre at speed that you couldn't handle. Once you have lost adhesion sliding sideways toward the curb, you would need to toss an anchor out the other side, brakes are of no use, ABS or not
If the ABS was, indeed, not functioning, you would have had a light on your dash to tell you so. Even so, without ABS, there are only two possible causes for the crash. One is you were driving too fast for weather conditions, which is why you did so much damage. The other is that you were driving too fast for the road you were on, which is why you did so much damage.
ABS does not prevent accidents, per se. It makes it easier to maintain control of a vehicle driven at appropriates speed when a stop is necessary in snow, on ice, and in rain.
