If I'm a passenger and the driver has a small amount of pot and a pipe in their car, can I be cited?

If the driver carries pot and a pipe in their car and I'm a passenger and we're pulled over and it's found, can I get in trouble too? (I do not do drugs). What if the driver is smoking pot at the time? What if the pot/pipe is in the trunk of the driver's car? Note: I'm always refering to the driver's car (not mine) and I'm not driving or partaking.

depends on the state laws, what they find, and the douchieness of the cop.

In Texas you would also be in trouble. You would both have to go to jail. Even if you were not doing the drugs. Here even if you get got with something in your car that may not be yours you will be sent to jail.

when i was 17 ...i was in a car and we got pulled over for failure to signal...guy in back threw pot out of the window... all 4 were arrested...2 got off and 2 pled guilty...ALL had to get lawyers

Yes you can be cited and yes you can go to jail as well until this is all sorted out...............

As for the truck, the officer can use probable cause to search the trunk as well........

The police officer has to determine who it belongs to in order for him to cite or charge anyone. He cannot charge everyone and eventually someone will admit that its theres. If its not yours and you don't do drugs there is nothing for you to worry about.

No, unless the driver tells the cops that it's yours, then you have to request and pay for a drug test to prove your innocence.
