I was procedding straight after stopping at the stop sign, I was half way thru when I was hit by another car on the drivers side, the car that hit me had the right turn signal on but did not turn went straight into me instead. Who is at fault?

Well if they hit you while you were already in the intersection then it their fault but if you took your turn a little early because you assumed he was turning then it may be your fault. Its hard to prove though. But since he hit you he will probably end up at fault.
You can't really assume someone is going to do something because of their signal, you should still wait your proper turn.
But they need to watch out too if you were already there and he went then its his fault. |

Witness would help in your case because it can't be proven if he had on a turn signal. Is sounds like his fault for misleading the direction he was going. But if he denies having on a right turn signal and he didn't have a stop sign, you'll probably be at fault for failed to yield. That's just the way it is. Stupid drivers do stupid things and someone else takes the blame. Anyway, let your insurance deal with this and be sure to tell them everything, that he had on a right turn signal but then hit you. If you have a claims adjuster that believes you then it might go okay. Your insurance company has a duty to protect you from liability. |

Well who got to the sign first? Did they ALSO have a stop sign? If they didn't have a stop sign or got to the sign first YOU are at fault. Doesn't matter if they had their turn signal on. You NEVER trust turn signals until the person is turning. So if they had the right of way then YOU are at fault. |

Your fault. Never , as you just found out , assume a vehicle is going to turn just because it's turn signal is flashing. Your action is commonly referred to as Failure To Yield Right Of Way. |
