Legally, it would depend if the police determined an alert driver could have stopped in time. And in these situations, the benefit of the doubt would go to the driver. As for speeding, if the police could show that the speed played a role in the accident that could reverse the decision and have the driver at fault.
My personal opinion is people should look both ways before they cross... |

The driver is responsible for his actions, not that of others , but he has to be in control of his vehicle at all times. The police would do an investigation and determine if the driver is at fault or not, based on eye witness statements and the drivers statement. Each case is handled on a Individuel basis. |

A driver is at all times responsible for the control of his vehicle, so yes, in both cases I think that the driver would be responsible, unless he had absolutly no way of seeing the drunk (for example if the drunk jumped from behind a car).
If I am driving, and see people that might behave oddly in traffic, drunks are one, but kids are another great example, I just slow down untill I have passed them. |

I think the driver is responsible. Unless there was absolutely no way they could have avoided the collision....like the person stepped out at the last second, or it was really dark and they couldn't see... |

The driver still has responsibility as they should be aware of what is going on in their surroundings and should be able to stop in a safe manner if something unexpected happens.
Even if the driver is below the speed limit it is still their responsiblity. |
